to think it's the supermarket's fault I fell

In a small branch of a major supermarket yesterday in perfectly normal flip flops. Walked past the fresh flowers which were in water and promptly slipped on some dropped water and fell REALLY hard on the floor. Instinctively put my hand out to break my fall and landed on my wrist. I am going to minor injuries tomorrow but am fairly certain it is broken - broke my scaphoid on the same hand last year and this feels very similar in terms of pain/tenderness.

The manager filled in a form and suggested I get it checked. He did point out that I was wearing flip flops which probably wasnt wise - WTAF???? I also heard one member of staff tell another 'we should probably put a mat in front of those flowers now'.

I am definitely not a 'where there's a blame there's a claim' type person but I am mighty pissed off that in all probability I will be unable to drive for 6 weeks - logistical nightmare to say the least - will be in plaster, will be in pain and will be inplaster for our 2 week spanish holiday through no fault of my own.

AIBU and WWYD???? (I know I should have gone to minor injuries today but I was in a state of denial which is now giving way to realism!)

user, she wasn't inadequately shod, she was wearing perfectly normal shoes of a type that the supermarket should expect its customers to wear.

How do you know this has not cost the OP anything and will never cost her anything? An injury like this could have knock-on effects for the rest of her life. I still have problems resulting from a broken ankle 25 years ago.

She is entitled to compensation for negligence because the law says so. Compensation is not limited to defined financial loss but also covers damages for pain and suffering and inconvenience.

I never understand this "Sometimes accidents happen" mentality round here. Yes, they do, and if it's your fault obviously you just suck it up. But if it was due to someone else's negligence, why should you? Isn't that why we all pay for insurance? And how far are you going to take this "Just an accident, suck it up" approach? If a broken arm has to be sucked up, how about two? What if you lose the use of the arm? Should you still suck it up when it was totally avoidable if someone else did their job properly?

Regardless of compensation payouts what if it had been an elderly person who slipped and broke their hip? There is no excuse.

From the OP. This implies that they know there should be a mat and that they probably actually have a mat. Thus they know there is a risk which could have been minimised.

@tactum please do update the store - you have been injured and inconvenienced by their negligence BUT ALSO if you don't take it further it could happen to someone else and cause a much worse injury.

You reported it at the time and they have CCTV. That's all the evidence necessary to make a claim.

I'm impressed there was actually enough water to drip significantly, unlike all the supermarkets round here whose flowers are always in a state of early death. [misses point of thread]

Tactum please notify the store and head office of the incident and the result of which has left you with a broken wrist. You will have out-of-pocket expenses. In addition to which the supermarket has a duty of care to its customers to ensure incidents of this nature do not happen.

I think you were treated unfairly.

Years ago I took a then 5 year old DS to Sainsbury's. It was a horrible wet day and the rain was blowing in through the doors so the whole floor was slippery. As DS walked in he slipped and landed on his bottom. I didn't think much of it but staff from the cigarette counter flew over to him, offered new, dry jeans and gave him a huge bag of sweets and a comic. I thought it was so lovely of them and I wrote to head office to say the same.
A little sympathy goes a long way.

I hate the claim culture, but have to say you are suffering through no fault of your own and the manager wasn't exactly pleasant. At least contact the area manager and see what they have to say.
