In the following context...

"He was jailed for nine years, with an extended license period of four years and handed a sexual harm prevention order lasting for ten years"

The order will have stipulations about internet use, being in contact with children or vulnerable adults or disclosing the offences to people one lives with. They're very dependent upon the nature of the offence

myoriginal3 · 27/05/2017 08:01

does it start after he's released from prison or from the date of sentencing?

License always begins after release from prison. If the license is 4 years they are anticipating he will serve 5.

TeaBelle · 27/05/2017 08:03

I think it would be from sentencing, but the license conditions are from release date.

Jupitar · 27/05/2017 08:03

It's for 4 years after he leaves prison

MermaidCafe · 27/05/2017 08:05

The license period is when the offender is in the community but would be recalled to prison immediately if any further offences committed

myoriginal3 · 27/05/2017 08:09

So what is the order then? thanks for your responses.

or more specifically, what happens if he breached the order?

There's some more information here, but if you're concerned about an individual you might do better to contact your local probation service.

myoriginal3 · 27/05/2017 08:18

No, I'm curious Maud as I don't understand them. He's safely imprisoned now so that's the main thing.

If they breach the license they will be recalled to prison to serve the rest of their sentence. If they breach the order they will be called to court for a judge to determine punishment.

Squeezed · 27/05/2017 08:21

If the order is breached then the person has a new conviction and could receive a custodial sentence. If the behaviour breaks the licence conditions then they could be sent back to prison for that reason.

Thanks.
