ASDA 70 pound fine for over staying in car park PARKINGEYE

Recently I was given a 70 pound fine (40 if paid within 2 weeks) for over-staying at the car park for 3 hours and 43 minutes, where there is a 3 hour max stay. (43 minutes over time).

However the reason for this is because I made 2 trips, first one for general shopping then after returning home i went back to asda shortly after as i had forgotten to buy something. I then received a letter showing my arrival time and departure time from the store.
18:41:45 and 22:25:17

Is there any way I can appeal this, as i certainly did not overstay at the car park and was only parked for around 1h in total.

I know there were a few similar threads to this although i'm not sure if the information is still relevant as the threads are a few years old.

Yes please call up the manager they cancelled it straightaway for me.. no reason required..

Agree with the advice about appealing and contacting the asda store direct.

Please please ignore any irresponsible advice telling you to ignore them; they are no longer unenforceable!!

Does anyone know exactly when they started to be enforceable? I followed this advice about an Aldi one I got 2 years ago, I'm now worried a CCJ is on the way!

Where do you live? In Scotland these are not enforceable

I still haven't appealed against my stupid parking fine yet.

I parked in a Parent and Child space to quickly take some money out of a cash machine. I was there for two minutes tops. The car park was empty, there were plenty of spaces left for anyone else who wanted them.

I couldn't read the signs because it was dark and the writing was tiny (I went back to check after getting the fine)

I really need to appeal if ignoring is no longer the answer.

Do not pay it. I got a fine last year from parking eye in our local asda car park. I spoke to customer services and they cancelled it for me, i had my reciept but they weren't bothered about that. I then recieved a letter a couple of weeks later from parking eye telling me that it had been cancelled. I did not engage with parking eye.

Look up the case of parking eye and beavis. The Supreme Court judgment came November 2015. I believe there is also a Scottish case.

You would likely know if you have a ccj as you would likely have received a county court claim form first.

If you appeal and explain what happened I think it very likely that they will let you off. I'm sure they don't want to lose customers over this sort of thing. Don't ignore it though.

So I went to the store and spoke to the manager, and after explaining my situation he happily said he would have the fine removed.

For anyone with a similar problem to me, I suggest talking to the manager in store.

They are not enforceable in Scotland.

All that happened with the girl from Dundee is she confirmed and very publicly in the press that she was the driver. The parking firms can only send their invoice to the registered owner but the fine if you like is payable by the driver. There needs to be proof as to who was driving. If you don't admit to driving the invoice is unenforceable.
