Fuming with car dealer

We bought a car 3 weeks ago for £4000 - BMW 3 series 2006 plate with 70,000 miles on the clock
Bought from a car dealer and the car came with a 3 month warranty as standard
Within 2 days the oil light had come on, we filled it up and within half a day it was empty again.
Took it around to local garages and they thought it was the piston rings which would cost £2000 to do.
Anyway, after a long argument he agreed to collect the car to repair and said it was done after a day.
He said it was the valve stem seal that was causing the oil issue and gave us an invoice from the garage next door to his shop that had done the work.
We have now had the car back a week and the issue has come back. Not as severe but using 1/4 of the oil every few days.
He is refusing to fix it again as is now saying it must just be as the engine is old it is burning oil!
What can we do?!

If he's doing that then I'd be going down there and smashing fuck out of any stock he had on his forecourt. But I doubt that approach will be echoed around here Grin

Btw you have 30 days to reject the vehicle under the consumer rights act 2015 so if you bought it 3 weeks ago that must be coming round. Citizens advice were particularly helpful with regards to this. You need to write to them officially rejecting the vehicle and that you are seeking a refund. Make sure you do it within 30 days of you are going down that route

I feel your pain op sorry to derail but I'm having nothing but problems with my car too.

Bought from an independent garage (2011 Ford C-Max) had it 5 weeks and the clutch went, not just a wear and tear clutch part the actual clutch plate was In bits, garage we bought off wouldn't fix it as had had car over 30 days ended up costing us £800 at local garage and now the steering has gone, it's electric steering so no easy pump to change or part going to cost £1800 for a new steering rack, surely that's something that shouldn't go like that !

I've had the flaming thing 6 months and has nothing but problems, it really stings as it's financed so currently paying for s car that's sat in the garage for long periods of time, I'm in district nursing so need my car, I'm on annual leave this week but god knows what I'll do next week or for weeks after as could take 5 weeks, no second car and no one to borrow off either wish there was some way I could just cut my losses Angry

He is just completely unreasonable.
He said in no uncertain terms he is not giving a refund, or doing any more repairs so to take him to court.
Then he put the phone down.
The court fee of £100 isn't the issue but doesn't it just increase and increase constantly? I didn't think it was just £100 and that was it

Check on your house insurance to see if you have legal cover, if you do they will often cover things like this and have a legal advice helpline you can ring free of charge.

If no joy with the insurance go to citizens advice, they will advise you. Costs will increase as time goes on if you use a solicitor. If you represent yourself you will only need to pay the court fees which are fixed.

The courts aren't as bad as people think, don't let him get away with it! Good luck!

He'll soon care if you inform all his other customers why you are there. What's he going to do? Call the police? Won't go well for him if he does.

I have a Ford Mondeo, the same age and with double the mileage. I've never had to top the oil up in five years of owning it. It is fine just with an oil change at each service.

In other words, the old usage you're talking about is neither normal nor acceptable. Get rid of the car now, unless you fancy spending four figures getting it sorted out!

I had this, car faulty after a week and he took it back twice to repair and left me with a crappy courtesy car that also failed, leaving me with no transport.

I told him I was officially rejecting the car and emailed him a car rejection letter (you can get a template online) and he still refused.

I left him horrendous reviews everywhere - Google, Facebook, Yellow Pages.

Within 2 days of leaving the reviews he rang my DP and arranged for the return of the car. Apparently he didnt want to deal with me as I was unreasonable Grin

I've just called him and told him he has until 3pm to decide what he wants to do otherwise I will be coming to the garage ( 100 bloody miles away ) for a refund
At this point he put the phone down

If you do reject the car you will need to stop using it from the time you reject it.

Start the small claims process. It is likely when he gets the paper work he will give you the refund. But the sooner you start it the more likely it will get sorted out.

does he have a website? If so I would inundate it with what a clear description of what happened to you and the service you got from the car dealer. Car dealers rely on good publicity and one bad publicity can be very damaging. Stick to the facts and I bet I'll change his tune.

I would avoid leaving bad reviews or anything negative on social media if you are seriously considering the court route.
