Hello
I wrote before about my creepy landlord who locked me in the house.
It hasn't happened since but I have been staying out of the house as much as I possibly can while I look for a new place.
And I found one! The only issue is is that it not available until Saturday and my next lot of rent is due tomorrow and I don't have enough money to put a deposit down for this new place and pay this month's rent. I was thinking of saying to him if I can stay till Saturday then he can keep my deposit (I am that desperate to leave I honestly don't mind losing the money) in my tenancy thing is says I have to stay for 16 weeks and give 4 weeks notice but I didn't sign an agreement, he just emailed it to me and I said 'ok' in reply.

He's not going to go for the keeping thr deposit thing is he? But living here is making me on edge and unhappy. The other day he stood outside the bathroom while I had a shower...just waiting there. He really creeps me out.

How about trying Woman's Aid or even speaking to the council? They may be able to offer you temporary accomodation/storage? Hope you get it sorted. What area of the country are you in? There may be people on here who could help?

No I didn't. I went into uni on the advice of people on my last thread and they or me in touch with a very lovely landlady who said she had a room free. I went and looked at it, met the people who lived there and found that place. I've just been avoiding spending any time at home. Literally coming back late at night and leaving early in the morning.

Your "tenancy agreement" in nonsense as you're a lodger, not a tenant. He can't hold you to it, legally.

I know that. I think I'm just going to leave the big stuff here and crash on my friends sofa. Drawers and stuff can be replaced

Although the other tenants seem nice so maybe if I ask if I could shove my stuff in a cupboard. Would that be too out of line? I don't want to annoy them before I've moved in.

He worded it in the tenancy thing is an advanced payment which will be returned to me when I move out. But when I moved in he said it would be my last month's rent

Instead of paying rent tomorrow, give him 4 weeks notice and use the 'advanced payment' as your last month's rent.

Then move out whenever you are ready.

If he has told you the deposit money is the last months rent then that should be fine and you are only stay a few days and he will be effectively paid until the end of the month.

Have confidence that it is a fair deal for him and just tell him that is what's happening. If he complains be confident and repeat that the deposit covers you till the end of the month.

Tell him today that you have found somewhere else don't wait till he chases you for rent. Also see if you can do it while another lodger is with you.

It also says I have today 16weeks and I've been there four. I was thinking of saying I lost my job so have no other option than to give my notice. This isn't a complete lie, I did lose my job but I have thankfully found a new, better paying one (things are looking up whey!) but he doesn't really need to know that.

Why won't you call someone for proper legal advice - shelter is free and they will be able to tell you exactly what your options are. Stop all the guesswork. You are causing yourself more distress by hiding from this issue rather than dealing with it.

Because it is too much hassle I have much other stress that I really cannot be bothered with all of that. I'm just going to ask my new housemates if I can shove my stuff in the cupboard and then go stay with my friend for the week.
I just went in and asked him if I could talk to him and he said 'no I'm listening to the radio' 😑

I'd also advice you don't tell him you're moving to a new place.

Tell him you've lost your job effective Friday with no further pay, as such you eoll move out sat and can't afford to pay the rent. You could lay it on thick and tell him you can't afford to eat either and he may give you back your deposit. But he can't get blood from a stone. If you tell him you don't have it, there is little he can do.

Sorry not read all thread and your previous threads. However as a quick point lodger agreements only effective when it is UPTO 2 lodgers. If more then changes to a HMO even if he lives there. So you should be on an AST and have your deposit protected.

Sounds like you could have this muppet in a corner should you choose to exercise you rights.

I remeber your other thread OP, by what you say about deposit it doesn't seem like you would owe him any rent. I second staying with a friend and just get out.

So you didn't sign anything? Then he can't hold you to anything. I'm an extremely honest person, but I would advise not paying the rent tomorrow (is it by DD - in which case cancel it today - so he might not notice it for a few days?). If you pay him in cash, say you don't have the money, but will have it by the weekend (he can't exactly hold you down and force you to hand over money can he?). Then move out on Friday/Saturday, then phone him, give your notice and tell him he can keep the deposit. He's getting his money, although not legally owed to him, and you're getting out with all your stuff.

Not unusual for things to be netted off that way.

Ok so I talked to him. He said moving out on the 25 th is fine. But im just going to leave my stuff here until then and go stay at my friends anyway.

I feel a massive sense of relief now.

take a picture of your room before you go - just in case he trashes it and tries to bill you for it when you come back.

also take your important docs with you - passposrt/birth cert/bank papers etc.

All important stuff is in my suit case. It's literally just a drawer thing and stuff like that which I couldn't really lug round my friends house.
