DC knocked over a cyclist

blueirishues · 31/01/2017 16:33

The situation was that I pulled up and dc opened the car door, a cyclist went into it and over the top. My door is damaged and cyclist shouting all sorts about going to sue Shock what are the rights and wrongs here?

OP posts:

You also need to watch your passenger door.
When I was pregnant I was walked down the road (on the pavement) when a car door was opened quickly and hit my stomach hard.
The driver was hardly apologetic.
I was actually on my way to my ante-natal appointment so she checked me over and I ended up having to be sent for an extra scan. Luckily all was fine but I had a huge bruise over my bump.

I am SO struggling with all these abreviations! What is a DC??? Is there a
list somewhere, (which I can't find??) explaining them, so that I can start to understand peoples' posts?

MotherOfDragonsNotBoys · 01/02/2017 18:25

A child ran into my dad on his bike across the road, knocked my dad into the path of a moving 30mph car in the other lane and almost killed him, your child is definitely in the wrong. Maybe put the child locks on the doors?

I'm not outraged by the child. I'm pissed of the OP started such a stupid thread and then buggered off.

Mynestisfullofempty · 01/02/2017 18:49

The OP ends her post with "what are the rights and wrongs here?" It seems to me that the 'rights and wrongs' are crystal clear, but maybe the OP was hoping everyone would say the cyclist should have been able to see into the future, sprout wings and soar gracefully above the car to avoid the door!
Hmm

HelloCanYouHearMe · 01/02/2017 18:52

When I learnt to drive, i was told not to drive too close to cars parked at the side of the road where possible in case someone opened the door... why wouldnt this apply to cyclists?

On a wide road, why cycle so close to a parked up car? Surely there is always the chance that someone may open a door?

KERALA1 · 01/02/2017 18:54

How many times Hello. If cyclists do this they get SHED loads of abuse from huffing and puffing motorists who they are "slowing down". Once again cyclists cannot win.

HelloCanYouHearMe · 01/02/2017 19:00

The OP said she was on a wide road KERALA

Obviously im making assumptions here but if the road was wide then there may have been space for traffic to pass, no?

Cycling down the middle of the road when you dont need to is taking the piss, but giving yourself some room to ensure that you arent knocked off potentially into the path of another vehicle....

Beeziekn33ze · 01/02/2017 19:06

Doesn't sound as if OP should be giving the child a lift if she doesn't supervise her. It could have been a car hitting the door.

NotYoda · 01/02/2017 19:09

Hello

Yes, you are making assumptions. I will counter-assume by saying there was a car overtaking, coming the other way. Or a pothole in the bike's path, or....etc etc

myfavouritecolourispurple · 01/02/2017 19:10

why cycle so close to a parked up car? Surely there is always the chance that someone may open a door?

as I said upthread, most cyclists are well aware of the dangers of being doored but doors can be opened very wide. I doubt pedestrians passing parked cars aware of the dangers though.

LOOK before you open your door. It really is not hard.

HelloCanYouHearMe · 01/02/2017 19:14

So to a degree 6 of 1 and half a dozen of the other?

The passenger should have looked. The cyclist shouldnt have been so close.

Flowersandbirds · 01/02/2017 19:15

This is a really serious problem for cyclists. Teach your DC the "Dutch reach" (to open a car door with the opposite arm which should force them to check behind the car). As a DC can't always be trusted, I'd double check too. I can't over emphasise how serious this is - the injuries from sporting can be horrific. An insurance claim could be the very least of your worries if you don't take care.

NotYoda · 01/02/2017 19:16

Hello

Also bikes don't have mirrors, so you don't get the chance to command a whole lane the whole time, so you don't know if someone is racing along behind you ready to overtake you at speed.

No?

NotYoda · 01/02/2017 19:16

Hello
No

KERALA1 · 01/02/2017 19:17

No. The cyclist is not at fault. The passenger should have looked and is 100% at fault.

You can' expect cyclists to essentially cycle in the middle of the road just in case some idiot opens a car door without looking. Try doing that on your bike tomorrow on a busy road and see the joyful response you will receive from car and van drivers. Hard hat definitely required Hmm

Flowersandbirds · 01/02/2017 19:17

Oh and in NO way is it 6 of one and half a dozen of the other! Cyclists get screamed at for riding in the middle of the road and shouldn't be expected to avoid people opening doors on them.

Daffyduck2016 · 01/02/2017 19:21

All cyclists are dicks - they should pay road tax if they want to go round suing drivers. Tell him to sling his hook or you'll get your husband to wrap his bike around his neck.

you should have given him false details and denied all knowledge of what he was claiming later Grin

Mynestisfullofempty · 01/02/2017 19:25

Daffyduck2016 WTF? Is that supposed to be a joke?

AskBasil · 01/02/2017 19:25

I don't see why cyclists should pay road tax, it was abolished by Churchill in the 40's.

Car drivers don't. We pay Vehicle Excise Duty. Don't pretend cyclists have as big an impact on the roads and environment, as cars. That's just mad.

HelloCanYouHearMe · 01/02/2017 19:25

I never said they should ride in the middle of the road, just to not close to parked cars where possible.

NotYoda · 01/02/2017 19:26

Yes, it was a joke

BengalGal · 01/02/2017 19:26

I haven't read all of this so sorry if I'm repeating others. Anyone who cycles knows you can't swerve to avoid a door if they do it quickly and you are very near. Of course anyone would avoid a painful collision if they could. And it also depends on the cars behind the cyclist or any attempting to pass the cyclist. since they had been parked for a while, finishing the song,, there was no way of knowing a door was about to open.

NotYoda · 01/02/2017 19:27

Hello

Where possible. Not should

Person opening door should look every time. Not "where possible"

So not really 6 of one half a dozen, no?
