Car has been clamped

I bought a car last night which my friend bought round for me, I've got up this morning to tax it so I can drive it as I've looked out the window it is being clamped for being untaxed. I ran out of the house to find out what was happening and told them I had just bought it and am taxing it I have proof of purchase plus email from dvla to show it's taxed but they are refusing to remove the clamp unless I pay £100 for it only being on 11 mins.
Is there anything I can do? I've had to get my mum to take dcs to school and there's no way I can get to work

So .. OP bought the car last night and presumably paid for it last night also. Why then wait until morning to tax it? Confused

Don't understand either why friend drove it round this morning and just dropped keys and slip through door? Seems a bit of a minefield re ownership times, insurance times, tax times etc. This thread is as clear as mud ....

I think everyone is missing what the OP is saying.

She taxed & insured the car, then looked out the window & saw it being clamped....she's shown her email as proof but the company still want her to pay to remove the clamp.

That is illegal because there is no reason for the clamp.

Quark, I read it that the clamp was attached before the tax had been paid.

So for no update I've only just got in.

To answer some of your questions I haven't paid cash for the car I will be paying for it in instalments so no cash has changed hands, so that's how I know my friend is not trying to scam me in any way.
The car has an mot valid for a year and as I said in a previous post my friend had paid Decembers tax by dd, unfortunately this months wasn't paid as she didn't have enough money in her account so it was subsequently cancelled, she didn't even know and had been driving it without tax.

The reason she drove it round and parked it outside my house, was to make it easier for me in the morning with dcs and so I wouldn't have to get a bus to hers in the morning rush hour to get them to school and me to work.

You will dispute it? On what grounds? The car wasn't taxed, the company who clamped it did nothing wrong.

Op deal with the dvla. Phone them up, tax it, print proof, phone police as very strange private company. The log book cant have been sent yet so your friend is legal owner till thats sorted.

Exactly! The car wasn't taxed. You should be asking your friend for the £100, not the DVLA/company.

It sounds like they've really clamped down (no pun intended)

Previously when I've forgotten to tax the car for several weeks (in the days of tax discs) all I've had is a warning on the windscreen or a letter to remind me.

And i think you should politely ask them to let you off but it's unfortunately your friend's fault so she should pay the fine (or if you are paying her in installments you could just not pay her the last one)

You realise that if you win any dispute you need to drop her in it and tell them she has not had it taxed for the last two weeks. It was clearly clamped because it's been untaxed since December.

Yep, it was absolutely your friend's responsibility to make sure the car was taxed and now she's landed you in trouble. Fantastic timing on her part. You'll have to have a rather awkward conversation about how you've had to pay a £100 fine on the untaxed car and of course it's not actually your fault so obviously she'll be knocking that off your first instalment.

When you taxed the car it would have been back dated to the 1st of January anyway, so I think you are right to dispute it.

If she hadn't paid Jan tax, it is her error here I think.

If you don't get anywhere with getting a refund, I hope she'd agree to knocking the £100 you paid off the purchase price, which should be easy to manage as you're paying in installments.

You can't dispute it saying you taxed it the same day or everyone would do this. Nobody would tax their car, and then if they got caught tax it the same day.

As your friend knew it wasn't taxed I'd be doing one of two things. Either she pays you back the £100 or you deduct £100 from the total you owe her for the car. Either way she'd be responsible.

You have no grounds to dispute this, the car wasn't taxed for January. I'd be asking your friend for the £100 or deduct from the price of car.

I don't believe that your friend didn't know the car was untaxed. Why, this month, rather than any other month in which the DD for tax was being taken from her account, did she not have enough money to pay? She would also have been notified of the unpaid DD. All sounds rather convenient.

Doesn't work like that. Otherwise everyone would just drive around with no tax and then wait to get caught and then tax their car that day.
