to remove the disabled parking signs?

I live in a small rural town and our road has no pavements and road markings. Someone has moved into a house near the end of the road that has a wide frontage with a small wall. They also have a drive with space for three cars. Many of the people in the road don’t have off-road parking, so park pretty much anywhere there’s space, including in front of this house.

The new owners have put up disabled-only parking signs along their front wall, which has stopped most people parking there. We don’t need the space but occasionally our visitors do. I have seen the new neighbours but not talked to them – we live up the road a bit so they’re not close neighbours or anything – and although I can’t see any signs of disability, I know many disabilities are invisible.

However, they have loads of space on their own drive! I think they’ve put the signs up just to stop people parking outside their house. The signs are just the ones you can buy online, there’s no council disabled white line on the road or anything.

I feel they are being selfish and hogging the road, which they don’t own. WIBU to sneak over under cover of darkness with a screwdriver and remove the signs? Obviously they’ll hate me forever if they catch me, and I don’t want to spark a feud. But it just seems a bit cheeky and I want to be cheeky back. (DH thinks I’m insane, obv.)

well I've just had a reply from the public right of way people at the council saying the following:

This route is not a definitive public right of way or a footway maintained by [county council]. The route on Land Registry is unregistered.

If you would like to claim this route then I have attached our webpage that explains the process involved.

Does that mean I can claim the path and keep it for myself?? Shall I?

Oh yeah claim the path for yourself and see what happens next. Unless the neighbor who put that bit of fence up has already made a claim.

I don't actually want the path myself, I just want to be able to use it. I'll call the number the rights of way person gave me and see what the deal is.

How cool would it be to have rights to the path, and YET AT THE SAME TIME let anyone (nice) who wanted to use it have access too! Totally my kind of power trip. Go for it!

you would need opinion from someone legal in that field... but that doesn't read that you can claim it... suggests:

  • not a public right of way
  • the route is not registered (not the land which presumably is)

the ability to claim it as a public right of way may require you to be able to prove use over xx period of time etc. - might be tricky if the other chap is the landowner and fights it...

land registry should show who owns the land...
I suspect that perhaps it is not a right of way if you get that response...

The number in the link was just the switchboard at the county council, and after a lot of digging around they were able to provide me with an email address for legal services (rights of way) so I've emailed them. I'll see what happens. I suspect akkakk is right, and it's not as if anyone has been able to use the path as it's fenced off.

It pisses me off that someone might be able to just claim this path as their own and not let anyone use it. I want to reopen it up for use by all (except intravenous drug users who'll throw their needles over the wall). Obviously if one of the neighbours does legitimately own it that's another matter.

Next call: to the district council (not county council) about the disabled parking signs.
