AIBU or is ebay seller about delivery timeframe

I bought a TV on eBay on the 4th and paid promptly. The listing said the seller would dispatch within 2 days of cleared payment and they marked the item as dispatched so I've been looking out for it and have tried to make sure either DH or I are in most of the time to receive it. We're self employed so haven't missed work but have had to do some juggling.

This morning the seller messaged me to say
"Hi there. Thanks for buying tv, will be posted out on 13th as im currently out of the country visiting family."

This delay was not mentioned in the listing or I wouldn't have bid as I needed it sooner. Because they didn't mention the delay in the listing I've wasted time and money on an item that won't be delivered in the time frame I require. Because they marked the item as dispatched when it isn't and they had no intention of dispatching it till the 13th, I've been waiting for it, which has caused me inconvenience. They seem to think it's no big deal but I'm annoyed. I've asked for a refund. AIBU?

I've started a case. It has to go to the seller first and if they don't sort it in 8 days eBay can assist. I just feel so frustrated.

Jul. 8 You didn't get the item
You requested A refund
Comments I have not received this item. I require a refund for this item, since you have stated that you have not dispatched it, even though you have marked it as dispatched, and cannot dispatch it until the 13th, which is outside the advertised delivery timeframe."

I sold a metal bed frame on eBay and the payment (PayPal ) took almost three weeks to come through ! We let the lady connect it same day it was bought/ auction closed - in hindsight cash on collection would have been a better option !!

I remember buying dc2 a pushchair off eBay, and waiting ages. I eventually contacted them and she said she would send it next week as she was still using it for her baby! (Cheeky cow-I'd already paid for it!)

Then when it arrived it stank to high heaven of cigarettes. That too was no returns.

He's probably sat watching TV with it right now.

Sounds fine to me. It's worth noting that a seller can put 'no refunds or returns' in their listings till they're blue in the face - it makes no difference AT ALL to eBay IF you have grounds to return in case of mis-description or item not working. All it means is that you can't return in case you've changed your mind - and even then if the sale was on a 'buy it now' basis I believe the distance selling regulations apply and you have a period within which you can change your mind - so don't worry about his crappy listing!
Hope you get it sorted out - I'd be the same as you and not want it.

Never EVER accept PayPal on collection items. You're leaving yourself wide open to no item and no money!

I was going to mention this. If a seller is relatively new to selling, then PayPal keep any payments made to them for a minimum of 21 days, to make sure the sale was legit and everything was received. They ask you to enter tracking numbers (if you have them) or shipping details on eBay as soon as the item is dispatched, so chances are the seller marked it as dispatched before he'd actually sent it, hoping to get his money quicker.

Think it depends myself.

I sold a lot of stuff at the weekend and said I would dispatch within 2 days. My grandmother died on Monday so im not dispatching until today

Just ask for a refund and if they dont open a case with eBay

eBay will side with you irrespective of whether he states ' no returns'.

That just means you can't return it if you decide you don't like it. It doesn't mean he can post it whenever he likes!

A lot of private sellers will put "no returns". All it basically means is, no "non fault" or "change of mind" returns. Not, they can't take it back if it's faulty / mis described.

Business sellers must accept returns, even if there isn't anything wrong with the item (within 14 days). Private sellers don't have to.

Yay I got the refund! Escalating it to eBay did the trick, so thanks to everyone who gave me the confidence and advice to do that. It's come through just in time to buy a better TV I was looking at but didn't bid on before because I thought the other one would be delivered sooner. So all's well that ends well!
