Neighbour using our drive again!

More of a wwyd as I really don't think IABU!

So, we have a garage and drive at the bottom of our garden but we don't have a car. In March I started a thread because I'd came home to find one of our neighbours had had a huge amount of building materials delivered onto our drive and there was a couple of builders working in the drive. He hadn't asked our permission and when asked about it he said that he'd squared it with our ll. Everyone agreed that IWNBU and after some snotty texts from him we sorted it out.

A couple of weeks ago the same neighbour parked his car on our drive and went on holiday for 5 days!

Yesterday I got a text from my ll saying neighbour was having family to stay and wanted to park in our drive, hope that's ok. It isn't, we have family coming to stay and need the space. She said she'd pass on the message. I've just got a text from the neighbour. It says that he's fine to move the car and we just need to text him whenever we need to use the drive!!

AIBU to think he is the cheekiest sod in the world? Help me write a response?

Tell your landlord that you expect a rent reduction if they are hiring out the driveway to the neighbour.

Your LL is enabling the cheeky feckers. Tell LL to say no, and not pass on any more of these requests. Your LL has absolutely no right to answer for how YOUR home is used!

I agree. If you can't use your drive you're paying less rent. Or hire a skip and leave it on your drive permanently

Your tenancy agreement should have various clauses (exclusive occupation, quiet enjoyment) which basically mean that the "interest in the property" i.e. the control of the property, belongs to you.

This means that your landlord doesn't actually have the legal power to allow someone else to use the space as they have rented it to you, in the same way that they couldn't allow someone else to rent a room in your house. Suggest you take it up with your landlord - disclaimer - I'm not a lawyer or an estate agent, but this is pretty standard in tenancy agreements.

Your neighbour is a cheeky twat. You need to put your foot down with your landlord. Tell LL that you rented the property as a whole and, given that you pay X amount for that every month, he has absolutely no right to offer it to your neighbour to use. The landlord must tell the neighbour that he cannot use the drive ever and don't ask again!

Well, right now, text the neighbour with "that's great, we need to use our drive from now until Monday morning, please move your car"

And then call your landlord and tell them to refer all driveway requests directly to you, and remind them that you are paying for the full use of the driveway.

It's your drive, you're paying for it! Your ll is out of order, big time. You could always charge neighbours £20 a day, upfront of course.

No I won't text you to move your car when I need the
Space because I do not give you permission to park on my property. Any vehicle or other obstructions will be deemed as abandoned and destroyed.

I don't know if legally you can remove and destroy but I don't think he will risk it.

Text ll - you rented me the property to include drive and garage. Any more texts from you or neighbour about using the property I pay for will result in a letter from the solicitor. I have the legal right to quiet enjoyment. I have also told neighbour no, and any cars or other stuff on my property will be deemed as abandoned.

Have you gates that you could lock or get ll or agency to pay for gates? Tell them you're having issues with trespassers.

Your LL is a wet blanket and your neighbour is rude. Text back -keep it short and firm- please do not park on my property. The drive is private and required for my visitors. Don't entertain any negotiations on times or anything like that. It's a concrete no. Put something on it -cones/flower containers/childrens bikes. Also letter to crap landlord.

nah, kids with suncream and muddy footballs are your best deterent. suncream never bloody washes off. there is probably a whole load of coke cans with suncream hand prints on them that never washed off my scrapped car..

We have a couple of houses we let and wouldn't dream of doing this.

They are both taking the piss. I'd text the LL and say you are not ok with this and expect a reduced rent if it carries on. This is not you enjoying your home.

Text your NN and say remove the car and keep it off.

Your landlord is the problem first and Foremost. would you not have rights similar to LL not allowed to enter your property. Can't think of the wording but something about 'tenant being able to have quite enjoyment of the property' ...

Tell the neighbour that you need use of the drive now and exclusively in the future, and any requests about using the property you pay for the exclusive use of need to be directed to you, not your landlord.
