We have just come back from a holiday in Devon and took my elderly parents with us. My mum is disabled (she has problems walking because of a broken hip that didn't heal properly and back pain associated with having had Polio as a child). On Friday we went for a day out in Torquey. I parked the car in a disabled bay and checked on the parking metre for parking fees. I know that often in Cornwall and Devon you still have to pay for parking even with a blue badge so I was fully prepared to pay. I was pleasantly surprised to see that parking for blue badges was free and so put the badge in the window and off we went. A short time later my dad went to put something in a bin, close to where we had parked and saw that I had been given a parking fine. I found the Traffic Warden and asked him why and he told me that it was because I was in a four hour only parking space and I had not properly displayed the time on my clock next to the blue badge. I told him I couldn't see any such sign about four hour parking, and he told me that if I disagreed then I'd have to appeal, and that he would not cancel the fine there and then. I paid the fine because I knew that a) it would be halved if I paid within the two weeks and b) because there is no way I could travel from London to contest it at Torbay Council.

I'm prepared for a flaming, but I'm still going to ask, AIBU to be totally outraged by the petty actions of this Traffic Warden?

Yep, I did read that. Please read both paras. On street parking does not refer to car parks.

It's always worth appealing if you feel you have been treated unfairly IME.I once parked in a spot that apparently wasn't a disabled bay (because the paint was so badly worn) I wrote explaining we were on holiday so didn't know the area and explained about the paint being worn away and the ticket was cancelled.So long as you write before the ticket is due you won't have to pay the double price if you lose.

I would suggest again that you check their own website - the link was not to the Council's website.

I wasn't in a car park! I was on the street in a disabled bay with a parking meter. I know that you have to pay to park in a carpark in Devon and Cornwall, blue badge or not. That's why I checked and double checked the parking metre ON THE STREET that said free parking for blue badges

If you check out the link below it explains that there is a 4 hr maximum stay throughout some of the car parks in Torquay regardless of whether you display a blue badge or not.

Malia, as an aside, is there a reason you are resisting the term "traffic warden" so stoutly? Is it deemed offensive?

But Malia she wasn't in a car park. The only parking near Princess theatre is on street

Nope, simply that they're not traffic wardens, that's all. They are CEO's and have been for quite a number of years. TW were/are employed by the Police.

Malia thank you. This is why I am so baffled, because I am used to paying parking in car parks in D&C with a blue badge, but this was free street parking. I feel that the goal posts were moved for me and I was caught on a back foot hence I just paid the fine. I could kick myself for doing so now!

No worries, I sincerely apologise. So what contravention code was the penalty issued for ie do you still have the penalty itself? It'd just be interesting to the see the reason he actually issued it and whether it was thee same as he implied when you spoke to him.

If on street parking is not time limited for blue badge holders, the clock is pretty irrelevant anyway, isn't it? Regardless of signage. It's got to e worth arguing the case.

The introduction of the TMA (Traffic management act 2004) changed a number of things - one of them was to change the name to CEO. So it applies to all officers issuing penalties on behalf of Local Council's (they may not always be employed by the LA, they are often employed by a contractor)

If you look on StreetView on Googlemaps on that street just in front of the Pier Point restaurant, there is a sign saying Disabled Badge Holders Only. Max Stay 4 Hours.

Was that where you parked, OP?

If you were in a disabled parking bay then there would be a time limit and the clock would have to be displayed. If you were in a meter bay then there would be no time limit. Was there a rank of meter bays with a disabled bay at the end for example?

Well I'm pretty buggered in terms of contesting the fine because I paid and therefore admitted liability. I will phone though because I'd just like to hear how the council will explain what I have actually done wrong, and exactly what I have been accused of.

On the ticket he wrote "displaying a disabled badge in an incorrect manner" and yes I still have the ticket.

We've all done it. You probably looked at the space on the ground where it said Disabled. And then didn't realise that there was a sign above the other sign.

OP, look on the bright side, now you know it was your mistake then you can stop seething and get on with MN'ing and put it behind you. It's annoying but it's just one of those mistakes nearly everyone makes from time to time. I find I forgive myself a whole lot better than other people. Smile
