To need some paid holidays

I've had a bit of a breakdown recently with work. Boss pays no sick pay, holiday pay etc. I work full time and after numerous years I have just had enough!!!! I would be happy with just one week, it's so unfair. I know I have a few days I need to book off this month but I also can't afford to take the hit in my wages. It's a law for a reason! But my employer doesn't care. Angry is anyone else in this boat Sad

Employers get away with it because there aren't any checks, it not being compulsory to take the annual leave you're entitled to in any case, and employees don't report.

Do you have a contract of employment?
You can't just be self employed by default - it must be something you have agreed to?
Have a look back to earlier paperwork.
How much do you earn - if you work full time you must have some tax to pay.
How exactly is that being taken care of?

If it is a PAYE job - then, in all probability, your only option would be to resign and claim and sue for constructive dismissal.

Try and see an employment solicitor - or failing that Citizens Advice.

Just because someone else 'wants' you to be self employed, doesn't mean they can treat you that way. You can't be a self employed receptionist for example.

If that was all that was needed, all employees would find themselves 'self employed'.

Do you get a pay slip?

Littleallovertheshop · 04/05/2016 21:49

Have you phoned acas for a chat? They're super helpful. Do you get pay slips? Are you on a zero hours contract?

Do you actually pay any tax, or NI?

Brokenbiscuit · 04/05/2016 21:57

OP, please give us a bit more detail so that we can help. Your current situation sounds completely untenable!

SwingingFromTheChanderlier · 04/05/2016 22:02

Yep agree with Broken unless we know your position we are no help. It really does not seem legal regardless of grey areas!
