To take back these boots?

Started a thread in chat but decided to chance my arm on AIBU aswell, sorry for multiple boots spamming.

Bought some boots instore (wanted to try them on in a few sizes and am generally shit when it comes to organising myself to send stuff back so seemed like a better idea). It was end of November.

They are now unwearable due to both zips buggering up, one of the teeth (??) on one boot has fallen out so it won't zip up, and the other zip lining has torn away from the other boot.

Had dumped them in the cupboard a couple of months ago as had not kept the receipt and had resigned them to being fucked but resentful at throwing them away. The tread on them is still perfectly intact.

Today I found the receipt and am wondering if I took them back of they would replace them (I love them, although thinking they may do the same thing again?) or laugh me out of the shop for trying to get new boots out of them 6 months after purchase.

Wwyd? Try and get a replacement or resign them to the bin? WIBU to try and take them back?

I took a pair of boots back to Clarks over a year after I bought them as the zip broke. They tried to find a replacement pair but in the end gave me a £60 credit note (only paid £80 for them
In the first place).

Always worth taking goods back if you don't think they lasted as they should!

Dh had similar problem with Jones shoes a few months ago. They refunded - shorter time period but I definitely think they will refund/exchange given the state of your boots. No way they should be that damaged!

£175 Bloody nora.

I spent £30 on a pair of walking boots and i'm gutted they've died after 3 years of regular wear. lmao.

March to the store and go fecking mental.

JessieMcJessie · 22/04/2016 09:12

Those M and S employees were badly trained. Refund for changing your mind- at store's discretion - they don't have to offer on at all and can be conditional upon item not having been worn.

Refund when goods are faulty- your statutory right and they are legally obliged to return or replace within a reasonable time, which varies case by case but in your case OP 6 months is absolutely fine given so few wears. Only potential get out for the store is where it looks like the customer has caused the damage eg by washing on wrong temperature.

CakeNinja · 22/04/2016 09:15

Oh god, Seeyou, going mental really isn't my thing!
It certainly won't be the fault of the poor staff in there, I have no intention of getting angry over them, they're just boots!!

Jake Grin at 'indoor shoes' - ffs, gravel indeed.

I'll be going this afternoon, place your bets on an outcome...

Although now not sure if I want another pair of the same as will possibly end up with the same problem!

In theory your entitlement under the Consumer Rights Act (given that you are outside the 30 day period, but within 6 months of purchase) is to have the boots repaired or replaced:

You can choose whether you want the goods to be repaired or replaced.

But the retailer can refuse if they can show that your choice is disproportionately expensive compared to the alternative.

If the attempt at a repair or replacement is unsuccessful, you can then claim a refund or a price reduction if you wish to keep the product.

www.which.co.uk/consumer-rights/advice/what-do-i-do-if-i-have-a-faulty-product

That said, sometimes retailers offer more generous terms than the statutory provisions.

JessieMcJessie · 22/04/2016 09:19

My DH bought some work shoes (ie nice leather ones to go with a suit) in Jones and the lining got holes in it which rubbed his feet, after maybe 3 weeks of solid wear. They replaced no questions asked and the replacements, identical shows, have been absolutely fine.

RealityCheque · 22/04/2016 09:24

You should have taken them back as soon as they broke. You do not need a receipt if goods are faulty or not fit for purpose.

As it is you should still take them back now. You should expect much longer life than that.

dowhatnow · 22/04/2016 09:26

Given the fact they are in such good condition elsewhere you shouldn't have a problem.

witsender · 22/04/2016 09:35

If not, could you get the zip replaced?

CakeNinja · 22/04/2016 09:45

Reality thing is, they aren't made by Jones, they were just the stockist, the boots are actually made by timberland. Which can be bought in lots of places. I think i paid cash for them in which case there wouldn't even be anything on my bank statement.
So really, would they have been under any obligation to sort it out as I could have theoretically bought them anywhere.
When the lining started coming away, I presumed they wouldn't have been interested as I had no proof of purchase.

wit I could, its what I'll probably do if I don't have any luck with Jones.

I think you should push for a refund or exchange, don't let them send them to their own repair service. I have sent shoes off to be repaired through them, and they have been ruined (and the service isn't cheap!). Have always had shocking service in Jones, and I won't shop there anymore.

If you get a replacement pair it might be worth having the zip seams reinforced by a cobbler.

Good luck!

monkeysox · 22/04/2016 10:32

Yanbu take them back. Good luck

FeliciaJollygoodfellow · 22/04/2016 17:44

Having seen the pics I think you should take them back as well.

CakeNinja · 22/04/2016 21:54
