AIBU to appeal as i don't feel it's fair

Will it affect my benefits

If it was at the end of the probation you may be ok with your benefits. So were you just let go at the end of your probation or were you sacked?

I don't we were harsh and would have been very helpful if the op had provided some detail.

It's a bit like asking for the recipe for a particular cake, but not telling anyone which cake it is. No one can help.

Thanks, I have been ill 3 times and had 2 complaints made about me by other members of staff but they won't say what these were, just it wasn't he right job for me.

I don't think there is any hope of getting your job back, but posters may be able to help with the benefits question if you tell us a bit more. It doesn't have to be the full story necessarily.

So you were legitimately dismissed. Sorry if it puts you in a financial fix but you won't have any right to appeal. 3 days sick in 12 weeks isn't a great track record tbh.

You were off sick three times in your first three months? Do you have long term health issues that have caused problems?
Sadly I think the attendance issues coupled with complaints during your probation means they aren't likely to give you another chance. Was there an option to appeal when you were given the decision?
If you're finding it too upsetting to talk about, you might struggle with going through an appeal.

think people are being harsh. To give advice we don't all need the gory details at all.

All you need to know is the time employed and the op to say.

Or
I was sacked because people made up lies about my personal life which reflected badly on work.

I'm aware the op didn't put that but no need for the for fucks sake comments.

I would imagine the op is worked up, worried and upset. It is not always easy to write clearly when you can't think straight!

Unfortunately I think darth is right, posters are all trolled out and patience is on a knife edge.

I have 3 deleted threads on the list of ones I have posted on and that's just from yesterday. It doesn't include the obvious troll threads that I didn't post on.

I hope the op is ok financially, but no hope for her job, sadly.

After just 3 months you have no legal protection from unfair dismissal unless it was due to sex/race/disability discrimination.

Even then you'd have to pay £500 to take it to tribunal and you wouldn't get much there anyway as you were so new.

You just have to put this down to a bad experience I'm afraid and move on. Shit happens.

I wouldn't be off sick three times in 3 months. I've had 1 day off sick (was sick) and had 2 doctors and 1 dentist appointment in 2 months in my new job but the dentist was due to a broken filling (first had to get temp one, went back for new filling they would not do it then and there so had checkup). I'm in my probationary period so realise I've got to behave. On the other hand I'm hard working, on time, polite and get on well with everyone. For you to also have issues with 2 other staff members marks you out (unless you're drip feeding) as a potential trouble maker and if I were your boss I'd let you go too.

Sorry if this is harsh and sorry for you losing your job but you need to take the above on board when you start a new job which I'm sure you will do. Oh and I've been let go in first month of a new job (not right fit, not working out it was a valuable lesson and I got 2 years back to back long term temping work immediately afterwards).

You have no legal redress or right of appeal if you've only been in the job 3 months or were on probation.

Being off sick 3 times in the first 3 months is a lot, and a legitimate reason to terminate a probationer, or a new starter, I'm afraid. I used to work at a place that used a lot of long term temps - and they would be terminated on their second bout of sickness within a certain time period.

Unless you are covered by the Equality Act 2010 the employer has every right to let you go and doesn't even have to give a reason.
Sorry but I think your first bonkers should be looking for another job and establishing whether you'll get a reference from this one.

Unfortunately, if you've been there less than two years you really don't have any rights (unless you're pregnant). However, a high level of absence IS a legitimate reason to sack someone even if you had been there longer.

Was it a probation period and you weren't taken on permanently, or were you hired and sacked?

You can appeal it but it wont get you anywhere as you were legitimately dismissed.
Just because you are unhappy about it and may disagree it doesn't change that.
Your energy would probably be better spent looking for a more suitable job.

Based on your posts YABU. Sick 3 times in 3 months is excessive, and really doesn't look good in a new job. They can sack you for any reason 3 months in. An appeal will o nowhere.
