First thread need some advice......
We booked a holiday sharing a villa with some family members our family and theirs we both paid £100 deposit and agreed to split the remaining balance.
They ended up pulling out, we carried on with the holiday paying the whole balance ourselves.
Just had emails from the villa people saying the £100 security deposit is due back, other family are saying it's their we are saying it's ours as they pulled out at no fault of ours (visa problems) who is right?

Ah! If its the security deposit then it's an entirely different matter and YADNBU to keep it!

If everyone had cancelled both your £100 booking deposits would have been lost. They knew this when they paid their deposit. You are not using them to subsidise your holiday Hmm, in fact they left you having to pay much more than you expected or also lose you deposit.

This is the security deposit YOU paid, so its 100% yours. They are either very ignorant about what an non-refundable booking deposit is or they are jealous you got a holiday taking the piss (I guess the latter, but maybe try to explain to them the former).

StrangeGlue · 11/08/2015 17:15

So they added a security deposit on top of the initial deposit of £100 each so you've paid £200 in deposits and they've paid £100 overall. Right?

Well this is yours totally as it's the security deposit (a cost they incurred for you) not the non-refundable initial deposit.

They're taking a punt as they want to make back some (all!?) of their initial deposit. Cheeky people!

As they contracted with you to share the cost of the holiday but then chose to pull out they should have either reimbursed you your lost deposit (i.e.paid you £100 on top of the £100 deposit they lost) of stumped up their half of the holiday. In still going you saved them some money. How on Earth do they not get this?

Roussette · 11/08/2015 17:39

They owe you! Why on earth would they think they get the deposit back, they pulled out after you had booked flights, cheeky feckers!

I would send them an email saying "NO". As an attachment I would add a bill for their half of the holiday which they reneged on.

Hi thanks for your reply we both paid £100 each to I presume secure the dates we wanted, the £100 coming back is a deposit they add on to the balance just incase of damages

Yes, this is why I asked...it is yours as it is coming back from the money you paid. It is nothing to do with their deposit.
