..to think my NHBC guarantee isn't worth the paper its written on

Name changed as this will completely out me, but I need help from someone knowledgeable. Our house is in it's ten year NHBC guarantee. I made a complaint to NHBC IN August 2014, it is still not resolved. We have problems with our floor and drains and drive. We have had four site visits by two surveyors and an architect.

The architect and the surveyors report found our floor was faulty, it doesn't have expansion gaps in the chipboard so the floor heaves vertically instead of laterally. It doesn't have a vapour control layer. The floor is damaged from poor construction.

Our drains have not been cemented in properly, the manhole wobbles. The groundwork wasn't completed properly so we have a void within one metre of our foundations. The drains and foundations are damaged by poor constructio .

NHBC accept our floor and foundations have not been constructed correctly as per NHBC guidelines, or Building Control. However they continue to refuse the claim based on there isn't enough damage yet. Our drive is subsiding, and you cannot hear yourself think when you walk across the floor.

I've escalated this to Consumer Affairs at NHBC and to the Financial Ombudsman. What else can I do?? Please advise

Slightly off topic but did you catch Watchdog talking about faulty Persimmon Homes, made me think of your issues OP.
I think it's an awful problem as most people pay a premium for a new house thinking they are getting a problem free new build and it seems that actually many people are getting enormous problems from the outset.

I've tried to put through a few claims whilst doing my job and every one has been rejected.

Message to 'myhouseisfallingdown'. I can help you resolve your claim to NHBC. BBC Watchdog or press publicity is not a solution; and the Ombudsman is only a solution for an 'end' to a claim, that is, money settlements. I do hope this message reaches you - I registered with MumsNet only today, after I did a Google search for'NHBC refuse claim' and your entry was about 3rd on page 1 of the search. NHBC do stand by their warranty - in the end, and when faced with facts, technical back-up, and logic - when the right person at Milton Keynes is reached.

Its about time that the NHBC were closed down. They concede that there are problems, concede that they should carry out the work and then they do not do it. They spend years procrastinating and try looking at cheaper options. They ignore your calls and state they will return your calls and never do. We have serious issues with balconies and doors at one of our flats in Newquay and we have now waited for about 2 years for them to do something. Two of our owners have since died without them carrying out the work. I tried again last week to speak to them and they ignore calls. They are a disgrace and we are now having to take legal action. At least our barrister can be paid collectively by all owners. The Government should act as they are taking money under false pretences. Don't bother with the Financial Omb. because even though they purport to be an insurance company there is no protection offered there. We will be taking matters up with the media as well as legal.

I really empathise with you and totally agree that the NHBC are more of a hindrance than a help. We bought our house 8 years ago from David Wilson Homes. we now have water running into our house from a leaking roof. we had an independent report done on the roof by a building inspector who told us that the leaks are due to poor workmanship b the builder. Even with this report David Wilson have refused to repair the roof and the NHBC have totally taken their side. There is no ombudsman for builders which is an absolute disgrace but there is one for the NHBC. I would advise you to contact ombudsman for NHBC that is what we intend to do. Isn't it shocking that people spend their life savings on a property and they can just wash their hands of you. We would have more consumer rights if we had bought a faulty car or washing machine. For a purchase as huge as a house, the bigggest purchase most of us will eve make we are left at the mercy of builders who refuse to take responsibility for their mistakes! Good luck with you issue it sound s even worse than ours.
