DH was driving the other night and pressed his brakes to stop at a red light before a roundabout. A bottle of water rolled from the back to under his brakes and as a result he couldn't press them. By the time he removed it and stopped, he was in the middle of the roundabout so obviously had to move out of the way and he was snapped by a camera. The notice of prosecution has arrived today. Would you appeal this?

No, it's a bug bear of mine. Do not leave loose bottles cans etc in the car. One of the mums of 2 school friends died as a can rolled under the brake as she was going down a hill, she couldn't brake and hit the wall opposite at high speed.

Fuck. I'd be very surprised too if it rolled from the back. Were you in the car at the time? Are you sure he didn't just run the red light and is looking for a (poor) excuse?

A friend of mine had a bottle wedged under the passenger seat and it knocked the airbag cables out.

I was just asking the question so you can stop vilifying me. That's fine if its his fault. He'll accept the fine. I just wasn't sure what the situation was when something like that happened. No, never had any fines or points before.

Agreed, Shayne - I find it how many people think they're too bloody special to be held accountable for their own stupidity and negligence.

Wonder if the OP will ever show her face again and acknowledge that the suggestion that her DP has grounds for an appeal is fuckwittery of the highest order?

Obviously it's his fault. Who else's couldn't have been? The water bottle company for making a bottle that fits under the pedals? The car manufacturer for not putting in a water bottle pedal net?

Hideously dangerous driving to have something loose in the car that could roll like this. Don't appeal, just thank his lucky stars he didn't kill anyone, clear out the crap from the car, and in future drinks are only in the car in square-sided bottles that don't roll and fit in cup holders.

I'm sure lots of people have had something rolling around the car that they weren't aware of, there's lots of holier than thouness on this thread but of course he shouldn't be appealing it. What would he even say if he did?

I would have thought that if he appeals on those grounds, he could make things worse for himself.

Surely being unable to break because you've left a bottle of water where it can roll under the pedals could be classed as driving without due care and attention / dangerous driving? That could result in a worse penalty than 3 points and a fine for running a red light at a roundabout.

So firstly the incident was still his fault so no you shouldn't appeal.
Secondly IF this was grounds for appeal how couid you possibly prove it even happened like that?
He should be grateful he didn't cause an accident

One of my scariest driving experiences was while driving along a quiet road (thankfully so I was able to coast to the kerb) and my sandle got stuck. They were a 'Birkie' type with a wedge sole and three straps.
The wedge heel got, well, wedged and because the sole was stiff , I couldn't twist my foot away.

I've never driven in sandles since but every year, I see loads of people do.

Hope it never happens to anyone, it's frightening .

Sparechange apart from being a parking brake obviously, it is also designed to double as an emergency brake in the event of brake failure. True the back wheels will lock up but at least the car will stop

Thanks for the responses anyway. He won't appeal. I've asked him all the questions you have and he couldn't answer them so I think he got his answer there.
