To Take Car Back For A Refund

Posting here for traffic, and hopefully some legal expertise.

I bought a car two weeks ago for £8.2k - 7 years old, 27,000 miles on the clock. The airconditioning hasn't been working very well. Turns out it needs completely replacing. The garage told me it would be covered under warranty. Turns out it isn't. It's going to cost £1,000 in parts alone. On the vehicle inspection report carried out before we bought it it confirms that the aircon has been checked. There is a note that says "A/C not very cold".

I would like to return the car for a full refund. Am I able to do so?

I have a Mini Cooper S 2007 plate
Bought it ( cash) from a BMW main dealer several years ago
When I bought it I was 3 years old 1 owner and 23,000 miles on the clock full service history

The first year the clutch /flywheel went on it BMW didn't want to know despite the fact that a clutch /flywheel really shouldn't go on a 3 /4 year old car with 25,000 miles
Apparently 2007 model was known to be a bit duff on the clutch /flywheel and it had happened to a lot of 2007 plate minis Confused

BMW wanted over £2000 to fix it I paid £1,100 at my local garage
2 month later the gear stick shaft went another £ 200

But since then it's been fine and just flew through it's MOT with just a new tyre needed

It's only done 31, 000 miles now as I rarely drive it though

That's quiet a lot for a 2007 car when I looked at trading in my Mini Cooper S which is full spec full leather air conGrin heated seats blue tooth and JCW FF kit BMW offered me 6000 and that was last year with 29000 miles ( thieving bastards )

As a general rule cars like to be used. A car averaging less than 4k miles per year may well have all sorts of issues related to lack of use. It's likely to have only done short journeys so spent a lot of its time running cold which causes more wear to engine internals for example. Also expect things like the clutch and exhaust system to have much shorter lives. I would also recommend that you check the manufacturing dates on all of the tyres as some may be original and need replacing. Look on the sidewall for DOT and a 4 digit code in an oval, something like 3609 which would signify the 36th week of 2009.

Thanks everyone. Hippy when I looked on Parker's and paid to adjust the value depending on spec and mileage etc. it came out very competitively. They also had the paintwork rectified in a couple of places, and they gave me a year's warranty (which I'n none too impressed with at the moment).

I am a bit freaked out by people on here saying Minis can be money pits (sorry to hear about all the experiences). From reading some owner reviews I didn't get that point of view :-(
