Doesn't all start again with our neighbours?
We live in a new build and have been here 2 years. All front gardens open plan. Next door moved in shortly after and began their unpleasantness with us an another neighbour. Harassment notices were issued to them. They disputed the boundary so I asked the builders to clarify this. Which they did and put in markers.
I thought great now we all know where we stand. However yesterday the neighbours moved the markers. It doesn't matter how many times I move them back they will be relentless. I've started worrying again now, couldn't sleep last night as it's playing on my mind. Any advice?

How much of the ground is in dispute and what are you and they planning on doing with the garden that the exact boundaries are important

AlorsMeh · 20/01/2015 06:41

I am sorry you are having to deal with these idiots.

do you own your house or is it rented?

MinceSpy · 20/01/2015 06:50

Have a look at the deeds of your houses, they are online, that should clearly show the boundary.

kappadelta · 20/01/2015 07:03

We own it. The boundary line has been clarified as the builders employed an independent surveyor who put the markers in. I know they have been moved as I have photos of when they were initially put in.

Can you put a fence up?

CitySnicker · 20/01/2015 07:11

Fence! They move that....police!

kappadelta · 20/01/2015 07:12

Draco - no fences allowed Sad

We are on market, have been on and off since they moved in . It just all gets really stressful at times and my anxiety has been worse since it started.

Could you dig a flower bed or something up to your boundary. is there much area in dispute

kappadelta · 20/01/2015 07:16

Red - they would just like as much as they can take. Plus they see the harassment notices as us 'winning' and they can't have that Sad

OP posts:
kappadelta · 20/01/2015 07:18

Red - also if we put a flower bed it the would just cultivate it as their own.

Redglitter · 20/01/2015 07:18

What charmers. can you do something like extend your drive over the area, lay a path or plant a flower bed?

If they're so keen on getting the extra ground it sounds like they have plans for it.

kappadelta · 20/01/2015 07:23

Red - it's where our garden meets theirs a lawn which just flows together then a flower bed. They dug a channel in the flower bed defining most of it as theirs even moving plants so they were on 'their' side of our flower bed.
They are relentless as their garden is their life.

Hi OP. You need an injunction for nuisance and trespass, backed up by a power of arrest. You need them neutralised before you sell. Have you disclosed the earlier dispute?

Redglitter · 20/01/2015 07:33

I'd agree sounds like it's time to take a legal route since clearly they're ignoring the friendly approach.

kappadelta · 20/01/2015 07:34

Disgrace, we don't have a buyer yet so can't disclose. What does neutralise mean?

OP posts:
DisgraceToTheYChromosome · 20/01/2015 08:20

Neutralise, in this case, means putting the fear of God into them. An injunction with a power of arrest for breach, or damages is the only thing that stops loons like these.

One thing I would suggest is the Gardenlaw forums, where you will be able to talk to fellow sufferers.

TheWitTank · 20/01/2015 09:17

Can you put in a hedge or 'attractive' fucking massive heavy quarry stones in if fences are not on option? If not, then absolutely take the legal route. The threat alone might stop them.

PfftTheMagicDraco · 20/01/2015 10:51

If it were me and I weren't moving, I'd be tempted to do something awful to my part of the garden. Massive twinkling outdoor ornaments, or kill all the grass. Or get a goat. Anything to rile them up. Failing that - strap a legal letter on them or kill them
