I'm not sure if I'm being bias towards myself and need to get a grip.

There is a rule that anyone who works xmas eve is expected to stay till 6 pm. It's done so it is ' fair on everyone'

However, I work party time, I usually finish at 4 pm. So, it's asking me to do 2 hours overtime, unpaid. We gave staggered starts, those that start at 10 it's their normal leaving time, those that start at 11 am are going home 3 hours earlier. Those that work 6-9 get an extra day off.

I can't work later than 4 pm. Lone parent and my child care shuts at 12. I have begged and got cover to my usual working time.

Work have reluctantly agreed to let me go at 4 pm.

Firstly I'm not sure how fair that is as a rule.

Secondly they are disappointed that I'm not going in on the first day back, which is my day off as I should be making up for the fact I'm leaving ' early' on Xmas eve.

None else is going in on their day off. I did ask as was told that other people were going away as they were off. I did say it was my day off too but they are insistent I should because of leaving early. These others that aren't going in either have xmas eve off too.......

Still challenge it. I suspect it's an oversight

vintagecrap · 22/12/2014 10:05

Its is indeed retail.
Im not shop floor staff, but am attached to a team, so get drafted in at busy times.

I supose it doesnt matter. This year im leaving ' early' next year i will be too and will be making it up, in their eyes as im in the first day of the sales ( as that is my rota'ed day in)

Its not going to be an oversight if they have 80 thousand plus employees, is it. Its just going to be one of those things.

I had similar in my job where I worked 7-3 and it was always a treat that we'd be able to leave early on Fridays if we had met targets, so we could all go at 4, so basically I never got the reward no matter what my work was like!
And I got tutted at sometimes when I left at 4, even though I was meant to be bloody leaving at 3.

Littlef00t · 22/12/2014 10:20

So let me get this straight, no one else working full time would be doing overtime? They might even be lucky and do a short shift?

You just carry on, accept people might be grumpy, and let them try and make you. They don't have a leg to stand on.

mushypeasontoast · 22/12/2014 11:14

I work in retail for a large supermarket. Department managers attend a one day training session on retail law. These are run by hr and are biased towards the company full of shite (I have attended ours and upset the trainer by challenging incorrect statements).

One person can make a difference if they really want to although it doesnt make you popular Grin.

In my experience most people are afraid to challenge even when they are in the right and accept the situation. They then moan on public forums about how unfair it all is.

grumpyoldgitagain · 22/12/2014 12:03

Being right is all well and good but it doesn't pay the bills, keep a roof over your head and feed your DD though

Sometimes you just have to get on with things even though it is shit and they are taking the piss

I guess you fall into the category of having to get on with it VintageCrap as it is better than not having a job if you kick up too much fuss over it

A large employer like that will know this and use it to there unfair advantage

tobysmum77 · 22/12/2014 13:41

seriously they can't expect you to work more than the hours you are contracted for, that's totally unreasonable. Erm have you pointed out that part timers are paid less?

tobysmum77 · 22/12/2014 13:42

seriously have you tried hr if it's a big company?

noblegiraffe · 22/12/2014 13:50

"Dear management, please can you confirm in writing your request that I work unpaid overtime on Christmas Eve, and also that I come in unpaid on my day off in the New Year so that I can get the appropriate legal advice regarding discrimination against part time workers"

19lottie82 · 22/12/2014 14:03

that's really shit, in my work everyone gets away early on Christmas eve!

CassieBearRawr · 22/12/2014 14:11

They are behaving illegally OP. Do you have a union, or a decent HR department?

I would be politely refusing to work the additional unpaid hours, and I would also be keeping a little record of every conversation you have with them about it, include copies of the rota or any emails where they bring this up.

No-one ever does the keeping a record thing, but honest to god it will help you if you need to rather forcefully tell them to back the fuck off.
