eBay dispute, so upset and angry 😞

I purchased what I thought was a designer wedding dress on eBay. Just to clarify it wasn't from china etc, it was from a uk seller listed as being used. Dress arrived and it was clearly a reproduction.

Tbh it was still very pretty but I spent more on it then I would have wanted to if I had known.

Lots of messages back and forth between seller and I, first she was being very civil and claimed to not know it was a fake Hmm she also discloses that actually the dress is brand new and she bought it from ebay herself and never wore it. I asked for a refund and she agreed.

Was packing the dress up to send back when I get a message through to say she's spoken to ebay and they said she doesn't have to issue a refund because she didn't use the word genuine (technically correct but she listed it under the designers name and never once used the words reproduction or based on etc) the dress was listed in the designers name in the title, description and item specifics. I've just put in a dispute on eBay because I feel she missold the dress and I should receive my money back (I'll lose out on about £20 between p&p the first time and having to send it back)

She can't be right can she? She clearly listed the dress under this designers name. How can ebay side with her? I'm so upset, this is meant to be my wedding dress and now it has such bad feeling attached to it. Which of us if being unreasonable?

I know in the grand scheme of things my problems are nothing. I'm 3 months post pregnancy and was so looking forward to trying the dress on and feeling pretty. Now I just feel like a mug Sad

In your case that you opened, state how you feel it's a copy. Bad stitching, material cheap and nasty etci have done this an few times and always got my money back

Thats a risky strategy Aeroflot Paypal might ask for proof its fake which really really is difficult to obtain.
She's better just stating "It wasn't by the designer the listing claimed" without getting into massive detail.

Sister that is still saying that it's fake. I have never been asked by paypal to provide proof. I have done this about 6 times with obviously fake designer bags.

Its not directly calling fake Aeroflot. You've been very lucky so far I think. PayPal can and do ask for proof and it's notoriously difficult to provide because high street stores don't like appraising eBay goods.

"it wasn't by the designer claimed" isn't calling it a fake, it's saying 'this isn't as described'. It's like saying 'seller claimed it was by M&S but it wasn't'. It's not saying fake, its saying 'not as described'. If she stated she felt it was a copy as you suggested PayPal would be well within their rights to say to her 'Prove it'.

Just as others have said, open a not as described dispute, seller listed as a designer and its not. Don't start saying it doesn't fit properly.

Basically if your nit saying it's by that designer your saying it's a copy. It seems the same thing to me. Designer good are made to a very high standard, so op saying it's an obvious fake. The quality could be poor, stitching wonky, so op Could prove that

ebay do take it seriously, and you'll get your refund. I know it is annoying as the buyer seemed nice etc but honestly just don't deal with her anymore, open a dispute and get your money back.

How do you propose OP prove it Aeroflot? Because to do so would require written proof on headed paper from either that designer themselves or from a business selling that designers dresses. Now, as OP has bought the dress from eBay what incentive do they have to help? None. I promise you I've seen fake disputes end with the buyer not being able to prove their item is a fake because stores just aren't interested in helping. At one point Office would appraise fake Uggs but even they stopped doing it because simply, why should they?

Saying it's a copy is saying "This is fake"
Saying it's not by the designer listed is saying "This isn't as described"

OP As others have said open a dispute. If the seller then magically says that she will now refund you return the dress, contact ebay (I've phoned in the past).

Explain you have a "not as described" case open and the seller has agreed to refund on return, but that you are concerned she will not refund the return postage (as she hasn't agreed to) and ask if they will send you a postage label.

They will then email you a pre paid postage label with the sellers address so you won't have to pay return postage. I've done this a couple of times in the past, as I don't see why a buyer should be out of pocket if the seller is at fault.

Then you shouldn't be any £ down Smile.

BTW which dress is it

Most wedding dresses need to be altered to have them fit well, I would be surprised if any dress & especially the genuine designer item fit OP without some alterations.

I'm sure OP will get a refund, just advising that any dress she buys will probably need alterations. So I wouldn't factor that part into desire to return.

Also when I made the comments regarding the fit I didn't mean that it just didn't fit me, I meant it didn't fit in a 'not fit for purpose' way if that makes sense? As in it was made badly, part of the reason it was a clear fake. Sorry I should have been clearer.

Still nothing from the seller but I'll keep you posted.

Hi ladies nothing to report, just wanted to show my face so it didn't look like I had disappeared.

Seller has until Friday and then it is in ebays hands so fingers crossed! So far I've had no reply to my dispute from her.

Update! eBay found in my favour after the seller couldn't even be bothered to reply. They are refunding me the dress price and the postage but have given me a return postage label. Happy days!

Great news op! Something similar happened to me but then the seller started being dodgy and not responding etc. It was easy for ebay then to decide what to do.
