To be foaming at dc school

To cut a long story short, my dh adopted my DS in 2009 after 4 year together, DS was 7 at time of adoption but have been with dh since he was 2, I told the school that DS surname had changed legally and took in new birth cert .
Fast forward 5 year and I have just received DS info pack for seniors as he starts in sept it came in my maiden name, DS who has learning difficulties then told me that he was told to write his old surname on sats papers 2weeks ago. Angry he didn't tell me at the time because he thought he would get wrong :( also he didn't understand why he had to do this and didn't question the teacher.
He got really upset when the letter came today, he already thinks he is different due to his various disabilities, he is very anxious tonight and has started to cry asking why isn't he the same as us Sad
I am seething... I feel rather peed off that the school have allowed this to happen especially as he is a very anxious child to start off with.
I even filled in his new school application form in the surname he goes by now, fgs he even has a passport with his name on.
Arrrrgggghhhhh.

You need to send copies of the deed poll to his secondary school and the LEA.

It wouldn't be his deed poll , would be his birth cert as it's a step parent adoption :)

sashh in what way is it a breach of the data protection act? All earlier names and phone numbers remain on your school record.

Will this always have been the case? that all names remain on record at school). DH recently found that he was adopted at 7; would he be able to find out his previous name through school records?

For SATS papers you have to write the name as it is written on the list that the LA provide.

Every year you should receive a sheet from the school showing your childs name, address, family contact details etc. These are printed off the computer records that go to the LA. As your son was adopted in 2009 presumably you have checked at least five of these. What name what showing on these records? If it was incorrect you have had plenty of time to inform the school of their error.

The only list we ever have to sign is a list to state who can pick up your dcs from school,nothing else.

Data has to be:

used fairly and lawfully
used for limited, specifically stated purposes
used in a way that is adequate, relevant and not excessive
accurate
kept for no longer than is absolutely necessary
handled according to people’s data protection rights
kept safe and secure
not transferred outside the UK without adequate protection

It's clearly not accurate and not being used in a way that is relative. I also think that the old name could be being kept longer than necessary.

Indigo18 he should be able to find information about his adoption from court documents/social services etc. Do his adoptive parents have any info they can give him? The adoption boards might be a good place to look if DH wants advice on finding his birth parents. My DH found out he was adopted by his step-dad recently aged 33. To say the last 2yrs have been emotional rollercoaster would be an understatement.

? It is necessary to keep all educational records until at least 3 years after that individual has left education, ( in some circumstances up to 20). The old names and addresses and phone numbers are part of the educational records, deleting them would not be possible or allowed.

It is definitely not a breach of the data protection act to keep records of the old name, there are clear reasons why this should be retained.

Sorry I am at work. Ds teacher wasn't in today but seentthe headmaster. He said he didn't know what has happened but will rectify it himself today. I need to go in tomorrow and pick up birth certificates as left them there for another photocopy. There was no apology . I will see what he says tomorrow and maybe ring the senior school myself. .thanks for all replys :)

A child in my class no longer uses the same surname as she did at the start of Y6. During NC tests week she wrote the name she usually uses and I added the registered name afterwards. Your DS's school should have been able to do that at the very least.
