Stolen my ds money

IscreamUscream · 14/05/2014 20:04

The Baliffs have taken an £80 fee from ds child support payment this month leaving a £20 payment. They are truely heartless taking this money. The csa told me from now on this is what they do when it is passed onto the Baliffs all because the nrp has to be chased for non payment

I read some stuff about this when I first had to pay the CSA, about two years ago. Being the NRP and having to pay made me look into it more, it was about running the CSA (or whatever it's called now) as a business and charging for the service of collecting maintenance.

VanGogh · 15/05/2014 09:24

I'm sorry, can I clarify? I'm confused and shocked.
You receive child support payments for your DS from his father.
Your DS' father is in debt
The debt of the father is being repaid from the payments that should be going to your DS?

VanGogh · 15/05/2014 09:25

Someone please tell me that I've misread the thread.

YouAreMyRain · 15/05/2014 09:27

I think the father had to be chased by CSA which involved bailiffs and bailiff fees. The CSA then charged these fees to the recipient of the money.
Shocking.

Yep he has been chased for years because he refused to pay. The csa then issued a few liability orders at court on him, still refused to pay. Then to my relief the csa said they had no choice but to send the Baliff to him. He came to an agreement with the balliffs (owes 5 grand in arrears) and then I recieved monthly payments of £100. This month the payment was on £20 because the Baliff had applied their fee to it. From now on this is going to happen according to the csa.

That can't be legal surely? ! Shock

diddl · 15/05/2014 09:45

That's seems stupid, doesn't it?

If OP is owed £100 a month, then that is what she is owed, surely.

And if the bailiffs are owed £80, then that is what they are owed!

Or am I thick??

Callani · 15/05/2014 09:53

This has got to be the most absurd thing I've ever heard. I'm genuinely astounded - OP speak to your MP about this, how on earth can you be responsible for paying off a debt for someone who owes you money?

Ludicrous!

IscreamUscream · 15/05/2014 10:44

Surely the £80 fee should be added onto the £100 therefore making him responsible to pay £180 leaving the £100 for child support. It makes me angry that the Baliff has taken this money without consent or knowledge that this was their intention. What makes it worse is that the father knew this as he was told of the fee but I wasn't.

This is utterly appalling and immoral. What can we do about this?

BMW6 · 15/05/2014 11:07

Raise issue with your MP, definitely.

good luck!

SisterMoonshine · 15/05/2014 12:13

I am amazed this can be allowed.
What can we do? I'm in.

diddl · 15/05/2014 13:11

"Surely the £80 fee should be added onto the £100 therefore making him responsible to pay £180 leaving the £100 for child support."

Well I would think so!

Is the "catch" that they got the bailiff in on your behalf iyswim?

IscreamUscream · 15/05/2014 14:30

I see what you mean, but it's csa procedure to do this in chasing non paying deadbeats.had the csa got tough with him in the first place this needent of gone this way.its like I'm in the wrong because he has to pay for our child

OP posts:
diddl · 15/05/2014 14:35

Oh yes I don't agree with it, if it came across that way.

But who should pay the bailiff?

Or indeed who does pay the bailiff?

VanGogh · 15/05/2014 16:55

That sounds absolutely vile and wrong too.

Please raise this with your MP. Good luck

DoJo · 22/05/2014 20:19

OP - how did you get on with pursuing this? I, for one, would be happy to help you draft a letter/email to your MP if you haven't got time to do it yourself, as this must be affecting parents all over the country and needs to be addressed.
