are you unreasonable to sue me? [[SPOILER ALERT for Greys Anatomy added by MNHQ]]

BEAR WITH ME PEOPLE

Your son has an autoimmune disease. A very serious one, they have literally no antibodies. Meaning they simply cannot come out of their protective room, you can't touch them, they can't touch you, if they go out of their protective room (which is in a hospital) even the slightest antigen can kill them.

I have a pioneering new treatment that can save his life and make his life more liveable, and bring those antibodies right back up. I know it works. The only thing is, this treatment is basically injecting your son with a strain of HIV. The HIV is 'inactive' meaning you wouldn't be HIV positive or have any of the negative effects.

On the last minute, you refuse the treatment.

I am very naughty indeed and decide to give your son the injection anyway without you knowing.

In a few days, he gets better. He can go home. You think it's because you've waited - but there was no chance of him getting better this way. I tell you what I have done.

You speak to legal and decide you're going to sue me for assault and battery.

On reflection, do you think this is the right thing to do?

People may soon recognise where I've got this from Grin it got me thinking and I'm genuinely interested in people's thoughts

I really did just post to see what people's opinions on this were. I actually study Medical Ethics as part of my Access Course so wanted to hear people's opinions on the matter, so thankyou for yours.

I really don't know TBH, but I doubt I would.

My child is able to live a fulfilling life, where other wise he/she wouldn't have I suspect I would be highly greatful that my judgement was wrong and somebody else vetoed
Against it.

Don't watch the programme, so that's my view as a mother.

If I was the parent I don't think I would sue as I would be too happy to have my child home. However the regulatory body should discipline you appropriately.

Also I don't watch Gray's Anatomy so I don't care about spoilers so I wouldn't sue you for spoilers. However mumsnet should discipline you appropriately, possibly with the naughty step.

I would say that I would probably be willing to take any risk to try and give m cild a life but would want to informed of that risk. However as you are probably a hot young Dr with a bright future you will probably be fine and may in fact win an Avery for it Grin

I wouldn't sue, but I'd make sure he lost his medical license. He experimented on a patient. What happens if the next time he does it, it kills someone? That's not someone you want to be in charge of saving people's lives.

How do you 'know' it works though? Presumably if it had been properly tested then it would be available as a regular treatment. I don't think a Dr can take it upon themselves to use a young child as a guinea pig like that! It may only work initially, then cause more problems than it solved. So the Dr IBU in this case.

Not seen the programme but from the info here, I am assuming the treatment is a retroviral delivery of a particular protein, loss of which causes SCID?

Would I sue? Yes. But I would have probably consented to the treatment in the first place.

The HIV thing is a red herring. It's just used as a delivery tool, and the cure has absolutely nothing to do with the biology or effects of HIV.

I don't watch GA, Tequila, so I''ll give you an unbiased opinion free from spoiler fury! (It's an interesting question so I can see why you've asked it.)

I would be utterly delighted if this happened with my child - her health and a normal life being restored to her instead of continuing in isolation and misery. I WOULDN'T CARE in the slightest that I'd been overruled - I would just realise how wrong I'd been to refuse consent. The situation would not be about me and my rights but my child's miraculous return to a full and happy life! I can't believe that any normal parent could possibly object.
