3 years ago through the CSA they obtained a court order for child support as my ex refused to pay. He still refused to pay and after many 100'2 of calls to the CSA they eventually goat bailiffs involved who last November made an agreement with him to pay £160 a month (a very slight drop in the ocean).Today I contacted the CSA to chase Aprils' payment to be told that as of this week the bailiffs will take their money from source, they took it all. Therefore under the new system I will have to pay the CSA for collecting my childs' money, then pay the bailiffs for collecting it on behalf of the CSA. I will therefore be in debt each month.
How on earth does this work. Surely the bailiffs charges should be paid by him and as for politicians saying it will encorouge parents to talk to each other. I suffered years of mental abuse from him so never want to see him again, but with no police reports (as I was too scared) I now have no hope of getting any help with his daughter.
These laws stink.

Yanbu. I'm actually quite shocked at this!

My ex does not pay the ordered amount of child support. They took him to court and got a judgement and the last I heard was the bailiffs went round and he'd moved. No idea where he is but it makes no difference because I didn't get a penny even when they knew where he was living.

What an absolute joke that the bailiffs can take their fee directly. Surely the CSA should meet this cost as a public service and then pass it back to the non-paying parent? Unfortunately, our society doesn't seem to want to properly tackle the issue of non-paying NR parents Sad. We need a culture shift so that everyone sees this as reprehensible. Not sure how to do that though?

It's an absolute disgrace.

As is the scrapping of legal aid for family law. The burden of proof for cases of domestic abuse is so high it excludes the majority of victims.

It's also incredibly misogynistic as in the vast majority of cases the resident parent is female and women tend to have lower or no incomes compared to their husbands, meaning they are much more vulnerable when it comes to separation and divorce.

And the fact that the party accused of DV cannot get legal aid makes it worse for both. He (usually he) has to be allowed to conduct his own case, including if he wishes cross-examining her and necessarily litigants in person are given more leeway than professionals. So you end up with an angry man amateur-questioning a woman who says he is violent to her. Wonderful.
