Long story cut short!

Took DS to doctors too have warts removed, it was a locum doctor she sprayed his whole hands with liquid nitrogen, he had 2 3rd degree burns and every other finger was burnt except his thumbs, had to attend hospital a few times and nurse at our surgery every day for 2 and a half weeks, DS had to wear cotton gloves on holiday and total sunblock!

The nurse we were seeing told me to sue the doctor! And I did put a claim in against her, he has been offered £1000 which is a lot of money but everyone including DH are telling me to knock it back!

That's the short story there's more to it but I'd be here all day typing!

What would you do?

Babbit in medical notes, the doctor hasn't admitted liability but it has been said the canister off liquid nitrogen she used should have always been used with a long cotton bud but she never used it she only sprayed!
The last time the solicitor called me he said he was going to send DS for a medical but that's never happened!
To be fair DS has no pain or anything now and has only slight scarring when his hands are either hot or cold!

In the letter solicitor wrote he said without medical evidence I am unable to value DS claim accurately the offer however is on the table should you wish to accept it

I was offered £250 first, we settled on £2500! The solicitor has to advise you of every offer they make but I would suggest this is a 'first offer', I wouldn't accept it and wait until you have the medical evidence. My solicitor always said to aim for enough for a holiday to put it behind you! Good luck, sounds awful.

Questions to ask:

Has liability been admitted? (If, yes your son will recover damages and it is just the amount still in dispute)
If not, what, in your solicitors view, are the prospects of bringing a successful claim?
What are the benefits to DS to settle the claim now without medical evidence? (there may be a risk benefit. Your solicitor should be advising you on risk etc.)
