To think we'll have to pay back pension credit overpayment from deceased parents estate

DF died 5 years ago. DM died 1 year ago. Sad

Benefit people say they were paid several thousand pounds in excess of what they were entitled to/ Looks like they hadn't mentioned all their savings to the benefits visitor that filled in the claims for them.

DB and DS want to challenge it, but I can't see what there is to challenge if parents had more savings than they should have had.

AIBU to think we just have to pay this from the estate if parents weren't entitled to it?

Your DH and his brother are right to challenge the claim to ensure that it's accurate and that they don't hand over a significant amount of money for no reason, but if the money is owed then of course it should come out of the estate.

Why does your DH and his brother think it shouldn't have to be repaid?

Its DB and DS who think it should be challenged. They just seem to challenge every little thing. Maybe they are right but I've just had enough.Sad . But don't think there are any grounds. What would they need to show for it not to be repaid? Haven't a clue about benefits.

I think savings of any more than £6k start to affect pension credit, and if you have more than £16k you lose it entirely.

It hasn't always been those exact amounts though, and can be affected by other things. Has a lawyer been dealing with your dp's estate, would you be able to ask them for legal advice?
