Just want to know where we stand. I don't want to give exact details but will give as much info as possible.

A minor celebrity posted a picture online of something they had made. A public site with an open page where anyone can view it (without having to follow/like the page).

If someone were to save the picture and then have the same thing custom made, would this be illegal?

No-one has posted her actual pictures publically (only sent them to the artist) although they have posted a picture of their item online (an exact replica of the item).

This person has found out and has written a big rant saying that it is theft and people need her permission to use her photos. Quite a few people have done it since the picture was posted last year.

Has any crime actually been committed? She has said she would have liked people to ask permission before using her photos for any purpose. Tbh, It didn't even cross my mind to ask permission, she never replies to 'fans' although I have gone right off her now.

Thank you for all the replies. To clarify, the celeb did not draw any designs the item. Let's say for arguments sake, that it's a cushion.

Celeb said she wanted hers to be pink and purple with diamonds on it writing the word 'love'. (item , colours and words have been changed for obvious reasons).

My dd liked how the celeb had designed it,saved a copy of the pic and said 'can I have one'. I found out who had made the celeb's, contacted the artist and said please can you make one for my dd (with the picture as a guide).

Artist made it and sent it to us. Dd put a pic of it online and 'tagged' the celeb I think that's what you call it.

To clarify, dd never posted any pics of the celeb's item, just her own version of said item. (which I've now made her remove).

Why is celeb boohooing anyway as surely anybody could have simply said to the artist "I want one of those cushions that you made xyz celeb" - done! You have nothing to worry about as far as I can see and celeb sounds like a twat. Really want to know who and what though!!!

I think the dispute should be between the celeb and the artist. What you describe is a 'finish' (I think - from the IPR Office website). She hasn't re-designed the item or created a new design.

Most people are flattered when someone copies something of theirs, especially a child. The photo your child took of the item is your child's photo of her own item and she has every right to post it on the internet, preferably with a reference to the artist who designed/made the item.

Shea just annoyed she's not original any more.

You could have easily shown the artist the Twitter post or whatever it was without downloading it, you could have seen it in person and remembered the idea.

But she's getting uppity about you downloading the photo because it's hers - but you did not make profit of it, you didn't reproduce it, repost it, so I really dont think a court could prove copy right laws have been broken as it was for personal and not commercial use.
And they'd have to prove you even downloaded it too. I can't see them bothering.

Was it done by the same artist the celebrity went to?
And was it just colours? Anything very unique or a particular design?
Because as an artist I will not reproduce a commission for another person without changing it. Because you commission art wanting an original, by creating a copy you depreciate the value of the original piece and it's in poor taste.

But if it's just colours that's fine they're not personal to anybody.
