To buy this land and risk upsetting the tenants next door

Long story short. My house is at the back of a large house which was converted into flats last year. I own the freehold to my property and have had problems with the tenants of the flats parking on what is actually my land. It got bad when the LL of the large house 'rented' a part of my property to one of his tenants as an extra parking space and it took a long time and solicitors letters to get it all sorted.

I also had to spend money on getting bollards and a fence to ensure no-one parked on my property.

My property is at the end of a T shape and I part is used as a passage to my house ( I have legal access over it) and a parking area for 5 cars rented by the LL to his tenants

However because of all the problems my solicitor has done some digging to ensure my legal right of way and that nothing comes back to bite me on the bum with the owners of the large house.

It then got interesting - it seems that the LL bought the large house at auction on a 99 year lease. My Solicitor saw the legal pack and there was no mention of the land on the paperwork.

He has now found out through the freeholder that the land does not actually belong to the large house but to the house next door.

The freeholder of the house next door has confirmed yes its his land but as he does not live in the house was unaware that the LL of the large house was using it as far as he was aware only I had access to it.

He has now contacted my Solicitors and offered to sell me the land, If I don’t want to buy he is going to offer the LL the chance to lease it from him but if he does that I am worried about my own access across it.

I am very tempted I can enlarge my garden and my husband (who rents a garage ) can also park his car on the property we can afford it and it may increase the value of my house and provide a safer environment for my DS and bump when he/she arrives.

But that is not going to sit well with the tenants of the large house and I can forsee huge problems with them as a couple were very abusive to me during the problem with the parking before.

I have a couple of weeks to decide. I know it would not fair to the tenants but its something they will have to take up with their LL as either he has been badly advised/mistaken or is chancing his arm renting out parking spaces when he knows its not his land (I suspect the latter).

According to my Solicitor there would be no legal or planning issues if I wanted to change the area to a larger garden (although I will check with the council myself)

So would I be UR to buy it

this is the same in any place that you live. think the square mile in london. Im sure that there is a network there, and if you are well known you are likely to get on. this is because you are a 'known' rather than a liability.

Yes, indeed. However, in the City, the land might have been sold to the highest bidder, rather than sold behind the scenes.

I was just struck by the mention, and immediately undermining, of a "waiting list".

In this situation, all the networks have been against the scamming git, but if not....?

I do think you get the same thing everywhere, I live in a town where I hardly know anyone and yet when my mums next door neighbour had to sell their house they offered it to me pretty cheaply and below market value because they knew it would save any fuss and they were very attached to it and wanted someone they knew to have it. It was just a right place right time kind of thing. I've also sold a car to a friend because it was less agro, I really think stuff like that is normal and if I were renting out a garage I'd prefer to rent it to someone I knew and trusted if it was possible

Not everybody sells to the highest bidder. I think there are often other values involved especially when it's a person rather than a corporation involved.
We didn't sell to the highest bidder for our house because the way they approached us (trying to gazump someone else meant that I felt that they would be more likely to be untrustworthy in the process even though we 'lost' out on over £10k)

That island mentality happens everywhere. I live in central London.About as central as you could make it.

I've been hated by the ultra posh and the ultra not. It's the nature of central London - mansions cheek by jowl with council estates.

I've lived here since 1992 and I'm sticking.

My pet hatred is people buying to let. It's a free world, but I'm afraid I think they are utter arseholes.

We got our house for way less than it was worth (and much less than it was on the market for) because we were the only people to offer who were not developers. Our vendor wanted to sell to a family. Her family tried to talk her out of it, but she was determined! The estate agent couldn't believe it.

Not much to report bin day came and went but OH was at home and bought the bin in.

Sorry if I sounded 'smug' about the garage and my BIL. The garages are owned by someone who had a business which went bust and now rents out the units as garages, there is no reason why my BIL would be allocated the garage through 'local connection' however my OH has paid for his garage up to the end of May he is going to contact the owner with a proposition that my BIL takes over the garage from mid Feb and pays the owner from mid Feb this would mean that the owner would get double the rent until the end of May, but we cant be sure the owner will go for that if other people have been waiting longer or he has someone else in mind for it we shall see.

The problem with parking in my area is that it is 10/15 mins walk from the esplanade, there have been an increasing amount of people who commute off the Island and don't want to pay for parking, so they will walk to either the Hover or the train to take them to Pier Head to catch the Cat.

I have a friend who lives nearby, if she has to leave home before 7.30 her 'space' is taken by a commuter as soon as she leaves it and it will still be there when she gets back home, at 6.30/7pm as the owner is still commuting, but come 8pm onwards all the commuters have left and there is ample parking, so it does make things difficult.

Also its OK now with parking during the day and weekends but seeing how close we are to the beach we always have holiday makers parking and it does get busy in the holiday season.

So touch wood, if the tenants know I now own the land they haven't said anything to me or OH as yet, in the mean time I am getting a quote from a ornamental metal fence company I have a yen for a black one with gold painted 'spear tops'.

Oh parking in your town is horrid and I have also been in the fast and loose with parking spaces in your town. Island people are amazed that you are upset that the property advertised with two parking spaces in the details, then the deeds only say one. They are even more amazed that you suggest the property is worth less as there is no on street parking in the nearby area.
Saunter down to the dell and have a cup of coffee watching the boats go by to chill out - oh I miss my Island home so much.
