AIBU to expect the garage to sort this fault out for free?

I actually dont know if Im BU so Im asking here before I call the garage with my expectations. If I am BU then thats fine. Expensive, but fine.

I bought a car 2 months ago. After buying it, it has problem after problem. The lights were coming up on the dash, took it to my own trusted garage who said it was easily fixed but he noticed the clutch was 'shot to bits'. The clutch was vibrating from the day I bought it so I asked the garage I bought it from to fix it. They did.

Yesterday I had to rush my ex to A and E and as I pulled up the handbrake exploded into bits. Its useless now, does nothing. Ive had to park the car on my front lawn in 1st gear.

Since I only bought it a few weeks back AIBU to expect the garage I bought it from to sort it out?

Second hand ? Should have at least a three month warranty on it, and 6 months from a main dealership.

Thats what I was thinking. I bought extra warranty that lasts 2 years but it doesnt cover handbrake.

There's no such thing as an automatic warranty. What you do have though is your statutory rights. They say that is the fault was present at the point of sale then the seller is liable to fix, replace or refund. Within the first 6 months it is assumed any fault was inherent at the point of sale and it is for the seller to prove otherwise. After 6 months it is for the consumer to prove the fault was there at the point of sale.

So based on that the garage should be sorting this out for you.

It also depends on how much you paid for the car,how the price paid relates to the market value and how many miles you've done in time since you've bought it.

Yes, it depends on how much you paid for it, its condition, how old it is, how much you relied on the garages expertise when you bought it. eg if it is an old banger you bought for £500 after telling the garage you knew all about second hand cars then no, if it cost you £10,000 and you told them it was important you got a reliable car in good working condition then yes.

I would be asking for a full refund.

2 months you have had this car and it's been nothing but problems.

I had this problem with a car I kept sending it back for the same fault which started 2 weeks after I bought it, kept coming back faulty they refused to do anything so I took them to court and won. They should be sorting it out.

Ive done less than 100 miles (I dont drive much) and I paid through the nose for it. About 1K more than if Id have gone private.

Its done 57k miles which really isnt that much.

I really really dont want a refund, I absolutely love that car. And every car I buy I have problems with, I just recently had to fight for a refund on my last bag of nails that I bought, I cant do it again just to go through it all again.

Sorry double post! So you've paid a premium for the car and covered very few miles. I'd expect them to repair it. When you say the handbrake exploded what exactly happened? Is there no resistance at all on the lever? My guess would be a snapped handbrake cable. Usually a cheap and easy fix so not really worth them arguing over if you see what I mean? What car and what year is it?
