To think I shouldn't have to use up my holiday to have Christmas off?

When the entire company is closed for the day?

I thought I had 5 days holiday left to take from now until end of March but no 3 of them are taken off me for Christmas Day, Boxing Day and New Years Day.

I'd understand if it was open and other people had to work, but it's not.

Well it depends really.

Are your 8 bank holidays inured in your leave allowance - cos if they are yabu. If not, you aren't.

That doesn't sound right - all of those dates are statutory holidays. Your contract however may stipulate that these says are rolled into your allowance, but that would only be the case ordinarily if you may have to work bank holidays (emergency services, healthcare, hospitality, retail etc.).

You should first and foremost check your contract.

What happened for spring and summer bank holidays?

What Crikey says. DH has to use A/L over Christmas even though his office is closed, but his public holiday entitlement is included in his A/L entitlement. What does your contract say?

Dh's old job was like that- it was in the contract, but really you just cut three days holiday off and forget they are there!!

My dh is the same as he works shifts and public holidays are rolled into his annual leave. His work is also closed so not like there's even the choice to work it. I've always worked in hospitality so it was always treated as just another day with no chance of it off

It depends how your holiday is worked out.

If you get bank holidays plus X number of days then YANBU. If you get X days and bank holidays are included in those days then YABU.

If your contract just says 28 days holiday then the Bank Holidays are included in that. Your employer technically has the right to dictate all your holiday.

You'd be best to check your contract. My old one said I got 28 days holiday but 4 of them would be used as the Christmas/New Year period.

I get 24+ BHs so the Christmas BHs obviously come out of that despite everything being closed - same as all the other BHs.

We're closed over Christmas and everyone has to take leave. Those who don't want to have the option to work from home those days. Is this an option for you?

My work contract always included bank holiday hiurs in the holiday entitlement so to get these days off we had to book it and use up the holiday. Most companies are like this aren't they?

I'm rostered to work on Christmas day - it is a shop, it is shut, I have to take a day's annual leave.... it is in the terms and conditions of the job.

Bank holidays you get off, and if you do work it you get an extra days holiday.

Are you part time? At my place the full timers get it all deducted automatically ( as they would have no option to work the hours back in another way) and the part timers in effect book the bank holiday. They can work the hours back instead on another day if it suits the organisation.
I think of it like this - pro rata always. If a person that works 40 hours a week gets 8 hours off for a bank holiday, why should a person that works 20 get 8 hours? That is unfair to the other. So the fair way is that they book off the number of hours they normally work as if it was a working day.

1 get 33 days a year, 25 days + 8 stats. Xmas day, Boxing Day, 1st jan, 2nd jan, Easter Monday are fixed and must be taken off, the other 3 stats I can work if I want and take off later.

Sounds fair to me if the days are included in your total leave.

I have to do this because I work part time (pro-rata BH allowance in annual leave). It does feel wrong having to book a holiday for Christmas Day but as a PP said, I book the BHs at the beginning of the year and then forget about the annual leave it has used up when planning leave throughout the year.

Even more annoying, the entire site get the 3 days between Christmas and New Year off except the PTers. It's an old union fiddle based on hours in the working day and as a PTer I do get paid to compensate for this but TBH I'd rather have the holiday!

In my organisation we have to take BH off - office is closed, fair enough but the office is also closed between Christmas and New Year and we have those days taken out of our holiday allowance!! Not fair from my point of view - if the office is shut then that's a business decision and not an employee decision but we pay for it by losing holiday.

And its not the same for other department they get the extra days on top of the standard holiday entitlement!
