about work not letting me have days off?

I genuinely don't know whether I'm being unreasonable or not.

At work we have two accounts to books days off - Account A and Account B.

I was never given access to Account A, as apparently they were changing it so there was no point (I'm kind of newish as started in May). Then they changed their mind but when I rang up IT to get it activated I was told it had been deactivated.

So I had been using Account B which listed how many days etc I had off and booked all my days off. I have since found out that this was wrong and I am not entitled to the rest of the days I have booked off. Time off over Christmas, appointments I've had booked etc, seeing family.

If I'd known I had less days I would have used them more wisely. So I'm quite upset about this and have since found out that my Account A actually never existed.

I feel pretty screwed over. But AIBU?

Sooo have you used up all your 28 days holiday?

OOAOML · 04/12/2013 23:33

Was the number of days very generous - how many have you taken?

BobPatSamandIgglePiggle · 04/12/2013 23:34

Surely you know how many days holiday you get? Its in your contract

CoffeeTea103 · 04/12/2013 23:35

How many days are stated in your contract? Surely you are aware of exactly how many days you're using up unless I'm missing something?

MistAllChuckingFrighty · 04/12/2013 23:36

Accounts to book annual leave, and they had different entitlements ? What fuckery is this ?

softlysoftly · 04/12/2013 23:39
Confused

So Account A doesn't exist?

Account B is wrong?

Didn't you know how many holiday days you get in your contract?

lackingimagination · 04/12/2013 23:40

All sounds very confusing and it IS difficult to keep track of holiday taken over the space of 12 months especially when it's often a day here, an afternoon there etc. And moreso when you are relying on a system to do the maths for you and keep you informed of any remaining entitlement. If it says you had x days left then you probably wouldn't think to question it.
Sorry I don't really have a solution for you though. Perhaps you could ask to take it out of next year's allowance? Not ideal but better than having to cancel arrangements.

Financeprincess · 04/12/2013 23:44

I don't think you have grounds to be upset. You should know how many days' holiday you are entitled to. It's in your contract.

PurpleValentine · 04/12/2013 23:49

I was with an agency then got taken on permanently so didn't sign a contract.

If you started May 1st you have approximately 8/12 if your holidays for the year by the end if December. How many days have you used? What are your contracted holidays?

neunundneunzigluftballons · 04/12/2013 23:50

Oh that is different when did you start permanently?

lackingimagination · 04/12/2013 23:56

Sometimes it's not as simple as 'I have 28 days holiday to take over the next 12 months'. As is the case with OP here.

Financeprincess · 04/12/2013 23:58

How can you be permanently employed and not have a contract of employment?

It doesn't matter that you worked via an agency before you were permanently engaged. Find your contract of employment, check how many days' holiday per annum are stipulated in the contract and work out how many you have accrued so far.

CoffeeTea103 · 05/12/2013 00:03

Usually when you need to take a day off the first thing you would think of is how many days do you have left?

lackingimagination · 05/12/2013 00:09

'Account B' was keeping track of her holiday entitlement and informed OP they had x amount of days off so OP went ahead and booked them. Unless I have misunderstood something here. Many people wouldn't think to question the system. If I asked the relevant person in my company how many days holiday do I have left and they told me 4 days I wouldn't question this.

neunundneunzigluftballons · 05/12/2013 00:13

It is my understanding that it does matter that you were employed by an agency first. Your initial contract was with them as was your holiday entitlement. When you took on the permanent contract with your employer your contract starts from the date of your new contract. This may mean the same thing or it may not depending on the contracts.

Financeprincess · 05/12/2013 00:28

Yes, but her previous engagement via the agency has no bearing on her holiday entitlement under her permanent contract of employment. They are entirely separate. She couldn't carry unused holiday from her time with the agency over to her permanent role, for example.

It's very simple, as others have explained. Your holiday entitlement is set out in your contract of employment. It doesn't matter what 'account B' says, or said. It doesn't change your terms and conditions of employment.

neunundneunzigluftballons · 05/12/2013 00:38

I think we are saying the same thing finance princess but I think although the OP started working in her current place of employment in May her contract changed from a contract role to a permanent role and that is what is causing the holiday confusion for her. She may have taken days before she was made permanent which are from her previous employer. That may be a factor in why your holidays are showing up over your allowance OP.

lackingimagination · 05/12/2013 00:40

Human error. People make mistakes. People may miscount, lose track of their holiday taken or be confused as to how much they are entitled to. They refer to the 'system' or relevant person. You assume you will be given a correct answer. What else could you possibly do in this situation - not take any holiday just in case they're wrong?

FunkyBoldRibena · 05/12/2013 06:34

How many days does account B say you were entitled to?
How many have you had off?
If account b is wrong, how are they expecting you to track and manage this?

greenfolder · 05/12/2013 06:35

Yanbu to feel a little miffed-i used to work in a similar business for years and knew how crapola it was so kept a good oldfashioned desk diary in which I wrote each holiday and balance carried forward so I could check. To be far, when I left they accidentally paid me for 8 days leave because of their incompetence.

Is there a solution? Look at what is really important-could you borrow the odd day from next year? Could you take a day or so unpaid?

ZillionChocolate · 05/12/2013 07:09

YANBU to be upset. If it's their error, maybe see if there's a compromise to be had. Could you for example do half days when you have the appointments?
