Currently 34 weeks pregnant and trying desperately to get house re-decorated before baby arrives in Jan i ordered some carpet for our bedroom and hall stairs and landing....

cut a long story short, the carpet was fitted and 3 hours later i discovered my pantry in kitchen - where all electric/gas meters are - completely flooded, luckily in with an housing association so therefore a plumber came out to fix the pipe which the carpet fitter had nailed straight through, unfortunately my new carpet had to be tore up so that he could fix it, plus there was water damage, oh and also an electrician to check all electrics were safe and also alot of things unsaveable therefore had to be thrown out :((

ive been bk to the carpet shop since as they were the ones who sent the fitter and now seems they are trying to get out of making this problem right, they have not yet replaced the carpet or even offered us our money bk or any money so that we can put this right :(

i need some help as to where i stand with all this :( please help me as this is a massive stress on me having two.children this time of year just trying to get home ready for our new arrival

all advice welcome!xx

When a tradesman accidentally damaged our property, he called someone out to sort it that very day, saying he could claim on his liability insurance. Whether he did claim I don't know, but we weren't out of pocket ourselves and neither should you be.
I'd second calling Trading Standards for advice.

I agree with quietbat.

This was our family business. It happened once or twice. We always put it right.

No question here. The fitter is responsible and if necessary the plumber will be able to confirm that he caused the problem. Whether the fitter is insured or not is hisproblem not yours. It's possible that the fitter is self-employed rather than employed by the shop. But either way you should approach the shop first and insist that they replace the carpet - and repay any out-of-pocket expenses that you've had.

Another day has passed after two days of being promised they wik 'sort it out today' not sure how much more i can take of this now ive had to sit in arrange other ppl to take and fetch my other children from school and all for a no show - just isn't good enough - at the end of my tether now think i shall be on the phone to trading standards/citizens advice first thing in the morning in not an unreasonable person all ive ask is that they correct their mistake - enough is enough :(

thankyou all for ur advice i jus hope we can get this sorted before Xmas and before baby arrives!!xx

How annoying for you! Definitely call trading standards and maybe write to the carpet shop telling them you're involving trading standards and that you'll pursue a claim in the small claims court if they don't resolve everything to your satisfaction in x time frame. Cc the letter to Watchdog and send it recorded delivery to their head office as well as the branch. Don't take no for an answer! Good luck!
