Last wee I bought new school shoes for dd aged 7. In the four days she wore them to school they have become so badly scuffed that water can get into the toes, and they look awful. I spent over thirty pound on these and thought that as Jones are usually good quality I would take the shoes back and get an exchange or refund, as while they have been worn, they are simply not the quality I expected and generally shoes should last longer than four days!
However the lady in the shop and her manager refused a refund or exchange due to the bad condition the shoes are in- well yes, that's why I'm bringing them back- they're crapSad
I'm now thirty quid down, dd hasn't got proper school shoes and apparently I should just suck it.

Aibu to expect shoes to last longer than four days and to expect a refund for such shoddy shoes? She's only been to school in them ffs, maximum two hours in the yard each day!Angry

Yes, I would call those not fit for purpose and start quote selling regulations to them until you get your money back.

DoJo · 25/11/2013 15:21

Serves you right for buying shoes in a betting shop...Grin.

Seriously though, the Sale of Goods Act is what you need - it covers products which don't last for a reasonable length of time and gives you an idea of the remedy you should be offered.

Sallyingforth · 25/11/2013 15:49

I don't want to sound unsympathetic, but you said the shoes had been scuffed which suggests that they might have been have been used for kicking or dragging along the ground. If that is the case then the shop may be right to to replace them. I hope that's not the case though.

HootShoot · 25/11/2013 15:51

Has your daughter said what she was doing that resulted in them scuffing so badly?

nancy75 · 25/11/2013 15:52

It really depends what your child has been doing in the shoes, the sale of goods act only applies if you have been using the item in the way intended. Scuffed suggests more than just normal walking/running around

Clarkshoeman · 25/11/2013 18:35

Difficult one as it does depend on how scuffed the shoes are within such a short period of time. Think it is worth dropping customer services a line though. [email protected]

pregnantpause · 25/11/2013 20:08

They're really very worn they look ancient and incredibly scruffy. one toe is almost worn through entirelySad , but she's not done anything more than normal playing, the lunch time assistant confirmed she hasn't been doing any vigorous activities in the yard as I have spoken to the school about it as I originally thought the teacher had let her do pe in them. But it was barefoot gymnastics last week. I will email customer services I think as I'm just so upset at that money wasted and they weren't at all helpful in store.

Did she hate the shoes by any chance? I can remember deliberately scuffing the shyte out of a horrible pair my mum got me.

pregnantpause · 25/11/2013 20:38

Thanks for that. I will return on Wednesday better armed.

No she chose them and broke her heart on Friday when I said she couldn't wear them and they'd have to go backSad I originally just wanted to exchange for a similar but sturdier pair, as I have bought numerous pairs from them which have lasted her well. But the uppers on these are just so thin. I expect scuffs, I KNOW they won't look new after one day on a school yard, scuffs and scratches on shoes are normal, but unwearable is another matter altogether.

I have had excellent customer service from Jones the Bootmaker. I returned a pair of nude patent heels after 6 or so months as the leather had bruised wherever it had the slightest knock. They exchanged them instantly even though I had no receipt.

pregnantpause · 25/11/2013 21:05

Perhaps it depends on the branch, I have the box, bag and receipt and nothing. I am going to the Cardiff branch, they basically said it's my problem, and dd must have 'done something' to them.

I've just had a chunk of heel fall off some shoes from Russell and Bromley - I only wear them to work and I work in a primary school. Have had them for less than 2 months, really only 1. They say it looks like wear and tear but if I am sure it is not to either take them in or post them to customer services. I don't consider breakages part of wear and tear so will be taking them in.

Could you post recorded delivery to customer services, with a request to send them back if they refuse to refund/replace? I agree you may have got unlucky in store. They do not sound fit for purpose.

Clarkshoeman · 25/11/2013 22:10

Pregnant pause are you able to private message me as I am the Area Manager for that store and would like to help you. I am new to mumsnet and don't know how to do it.

Clarkshoeman · 25/11/2013 22:28

Alternatively you can send your contact details to customer services at the above address stating you wish to be contacted by the area manager of the Cardiff store and I will contact you.

gimcrack · 25/11/2013 22:35

Sounds like they may be faulty. Under the Sale of Goods Act a product must be fit for purpose and last a reasonable amount of time.

Follow it up with the poster who has offered to help.

pregnantpause · 25/11/2013 22:45

I have pmed you Clark. Thank you for responding, I appreciate it.

Well, now that the thread title has been changed, my post looks like I was making an even worse joke than I was originally... Blush
