After i reported my neighbour for anti social behavior after several incidents and he (the landlord) said to me 'I think you are beggining to make it up' .When the incidents actually happened ?

YABU. I think that's a bit of a stretch to call that slander, it's just him being an arse. Don't you have proof of the actions (photos, recordings, police reports, etc.)?

AngelsLieToKeepControl · 16/09/2013 21:39

It's hardly slander is it? Confused

He said it to you by the sounds of it, and unless he witnesses something or there is evidence that the neighbours did something then he can believe who he wants.

What sorts of things were you reporting?

silkboots · 16/09/2013 21:45

It doesn't matter what my neighbour was doing but it was several things.I involved the police and i felt he (the landlord) was indirectly saying to me that i was wasting police time. The police did act upon it and interviewed the neighbour but she denied it.I don't like being called a liar especially when i'm not lying .
Has my landlord accused me of lying the way he worded it?

No publication.
Needs to be to a 3rd party for any defamation law to kick in

ATruthUniversallyAcknowledged · 16/09/2013 21:48

Slander would mean that a 'right minded person' would think less of you because of his comments - ie he'd have had to have said them in front of someone.

From your description, he sounds guilty of being an arse, but not necessarily a slanderous one.

Tiredmumno1 · 16/09/2013 21:49

I thought slander was if someone said something about you to someone else that wasn't true.

But yes it sounds like he thinks you are lying, tbh don't worry what he thinks, you know the truth.

silkboots · 16/09/2013 21:51

thank you very much for you advice ruth , mayor angels and reggie it's much appreciated.

An opinion ("I think....") is not capable of being slanderous, and even if it was, slander is not actionable per se (without proof of damage).

You have no just cause to accuse him of slander. It's not really surprising you're annoyed at being called a liar when you were telling the truth.

AngelsLieToKeepControl · 16/09/2013 21:55

Look at it from the landlords POV, you are saying something did happen, the neighbour is saying they didn't, the police interviewed, but didn't charge the neighbour so I assume there is no evidence. What can he do?

You have my sympathies though, I have lived in the same street as a very sneaky antisocial neighbour, he didn't get caught doing anything and it is really frustrating. Hope it all gets sorted for you soon.

silkboots · 16/09/2013 21:56

ty :-)

LeaveTheBastid · 16/09/2013 21:57

So what of he think you are making it up? Unless he is provided with solid proof that you are not then he has every right to an opinion. Either provide him with solid proof (quick to record him saying he thinks you are lying so surely you should have proof of neighbours behaviour) or be prepared to have people question you.

Slander no defamation of character? Wow.

LeaveTheBastid · 16/09/2013 21:58

*and, not no

reggiebean · 16/09/2013 21:59

silkboots I was meaning a recording or any proof that the neighbours were actually performing said behaviour. If there's not, afraid it's just your word against theirs, so would keep a record from now on if it continues to happen. If it's taking photos, or recording sound, or whatever is happening, just make a record of it however possible, as that will help with your case with the police and with the landlord.

silkboots · 16/09/2013 22:01

the landlords offices record all calls

silkboots · 16/09/2013 22:01

n1 reggie :-) ty

reggiebean · 16/09/2013 22:04

No, sorry if I'm being unclear. You need to get proof that the neighbours are actually performing these actions, not just that you're reporting them. Not sure what they're doing, but you need to either get photos or videos of them doing it, or record the sound if it's loud music or something like that. Otherwise, no matter how many times you phone the landlord or the police, it will still be your word against theirs.

silkboots · 16/09/2013 22:05

It's ok i have managed to stop the neighbours anti social behavior but i am annoyed at the landlord not believing me.

OP posts:
reggiebean · 16/09/2013 22:08

Ah. If that's all it is, you'll probably just have to let it go, as annoying as it is. Sorry.

silkboots · 16/09/2013 22:16

thx reggie :-)

Hissy · 16/09/2013 22:19
