I am actually fuming and it is possibly clouding my judgement.

Last year I drove into the back of someones van, I was 8 month's pregnant and bruised the insides of my bump when I hit the steering wheel, I was in so much pain that an ambulance came and took me to hospital..ironically I was on my way to a hospital appointment for pain injections due to spd.

His van had a small amount of damage, he was stationary and i was going about 5 miles ph so it wasn't a horrific accident I just didn't stop in time.

I was so upset that I kept apologising and even rang the man afterwards, his only concern was me and my 3 year old he kept saying it was just an accident don't worry he was communicating with dh over the repairs, we couldn't afford to not go through insurance so it did, all went through everything sorted claim closed and he even rang to say all ok and hope all went ok with the birth of our new dd.

Fast forward 8 months..I get a call from an old insurance company saying someone had loged a claim that I had gone into them, I could prove it didn't happen as I was in hospital at the time with hyperreimis (horrible pregnancy) and further details showed actually it is the above man trying to make another claim for the accident on a different date, I got them to communicate with my current insurance company (like getting blood out of a stone) and today I finally accomplished getting the file closed..

However my current insurer has told me the above man has logged a personal injury claim against me..for whiplash.

Now if he had whiplash I am the queen of fucking sheeba, he is out to get quick cash! Hes made a fraudulent claim and now this bollox,

Aibu to track him down and give him something to claim about?

My premium is going to be horrific as it is, how can someone be so fucking cruel!!!

I had this happen to me, I went into the back of a learner driver, the instructor was really lovely and the tiny scrape of damage to his car, several months later I get a letter saying the girl (learner) was suing me for personal injury to her neck, I saw her jogging past my house every day, she lived a few doors away from me Angry I told the insurance company this and they god her to prove her injuries with a private medical or they wouldn't pay up, funnily enough she didn't pursue it.

You might find this article interesting. It talks about Britain being the whiplash capital of the world, and shows that the number of claims has increased despite the number of accidents going down. Another one here talks about a 70% increase in whiplash claims.

I'm with you OP. I'm willing to bet money that he's had a letter in from some injury lawyer and seen a way to make a fast buck. Hopefully the legislation change will bring about a decrease in these spurious claims.

To Fanjo I reported my incident to the police, who said they were well aware that the set of lights that it happened at were being targeted by insurance scam groups. The junction even appeared on our local news a few months later, with many people saying they'd had accidents there where someone had stopped very suddenly (for no reason) at the lights. And then miraculously men with clip boards appeared within seconds, popping their heads through the window, talking about whiplash.

That does sound very suspicious, Lou. While some cases of whiplash might be genuine, there are a lot of people just using it as a way to get money. I read that 50% of cases were thought to be fraudulent.

I'd be nclined to believe in his injury if he can demonstrate he's been to his GP or visited a physiotherapist about it on several occasions between Dec 12 and now.

Other wise I'd be less than impressed.

Happened to me 6.30 am moriing on way to work traffic lights in rain.

driver in front stopped dead on an amber.
i was on my scooter
i came off my scooter
damaged my bike.

he had scratch seemed fine police appeared.

I was very bruised he was fine.

then when phone him his wife said he stressed
then insurance company said he claimed whiplash.
yet barly scratch to his car,

I was fuming but I was at fault couldent contest it.

Similar thing happened to us after an accident my husband was involved in. We received a summons from the court (which should have gone to the insurance company and thankfully when notified they did deal with the claim) suing my husband for £300k. Stating a whole catalogue of minor ailments and PTSD, unable to accept a promoted post again (he had been demoted due to an unrelated employment dispute which I understand he is also suing the employer about)... An absolute joke and just an example of the claim culture we live in and the cowboy solicitors who try to claim for as much as they possibly can.

This finally resulted in around £15k going to the claimant which makes me so irate, but I was delighted with my insurance company and how their lawyers fought this chancer. The legal costs were significantly more than the settlement figure and our insurance premium more than doubled but we have clear consciences and that piece of scum has £15k in the bank.
