This is trivial (couldn't bear to put 'light hearted' in the title)

Tina GAVE BIRTH to baby Jake, it's not her egg (it's Izzy's) She wasn't arsed at all throughout the pregnancy but now he's been born, she keeps saying he's hers and she won't give him back.

HE IS NOT 'hers' in any way shape or form and I a) Can't believe there's nothing that the law could do about this and b) that someone could be so unbelievably and horrifyingly selfish - surely no one would be in real life, no matter how much it hurt?

I would have got a lot more shouty and punchy by now if it was me.

DH likens it to us taking my gorgeous niece away from DILS because 'we love her' and then no one is able to do anything about it.

Stupid, stupid storyline and poor form for Corrie.

Now would someone please pass the Camomile Tea valium Grin

A similar story line was used by Ruth Rendell years ago as a subplot: inspector Wexford's elder daughter acted as a surrogate for her ex and his new wife but then fell in love with the baby when it was born- but miraculously the OW then turned up and changed her mind about wanting the baby.

apostropheuse · 12/06/2013 21:34

Well you can't have it both ways. If you donate an egg you can't change your mind and demand the birth mother hands the baby over at birth because the baby isn't her biological child.

I believe the person who carries and delivers the child is the mother. I also think that unless you've given birth it's actually not possible to predict how you will feel when push comes to shove and you have to give up that child.

Anyway - back to Corrie - I'm on Team Tina! Grin

The father is the person named on the birth certificate as long as he is has not fraudulently put himself there.

If he is named on the cert he has just as much of a responsibility as the mum.

LalyRawr · 12/06/2013 22:18

If Tina was married her husband would go on the birth certificate uNless he wrote a letter stating that he did not agree to the surrogacy. In this case Gary can go on the birth certificate as long as he is there at the time of registering and as long as he has Tina's permission.

In an ideal surrogacy, Tina would be down as mother, Gary as father and at 6 weeks old, adoption papers will name Izzy as the mother.

If this story was real and Tina intended to keep the baby, then she would go down as the mother with the father left blank.

Ironically and rather hideously, Tina could then go to the CSA for maintenance payments from Gary.

My daughter and I barney about this e-v-e-r-y episode. She's Team Tina, I'm with Izzy.

Locketjuice · 12/06/2013 22:28

I'm confused., so it was izzys egg and izzys partners sperm? Inside Tina and she cooked the baby for however long, what would a DNA test actually say its izzys or Tina's?

Dim doesn't quite cut it tonight Smile

Locketjuice · 12/06/2013 22:31

Andddd if it is biologically izzys then wouldn't Tina signing the birth certificate be some kind of fraud :s

LalyRawr · 12/06/2013 22:34

No Locket. In the UK, whoever gives birth to the child is the child's legal mother, DNA is irrelevant.

Tina legally has to be named as the mother on the birth certificate and at 6 weeks, Izzy can adopt her own child. If Izzy goes down as the mother then that is fraud.

I know it doesn't make sense, but UK law is very slow in updating with the necessities of the time.

blackbirdatglanmore · 12/06/2013 22:35

No, legally the woman who gives birth to the baby is its mother in the eyes of the law.

Redbindy · 12/06/2013 22:40

What's happening about Dev and the fire at the Rovers?

valiumredhead · 12/06/2013 22:41

I think the complete opposite to the OP and can completely see how Tina can't bear to give him up. It just shows that the theory of surrogacy is easier than the reality once you've actually given birth and your hormones kick in.

Izzy's whining annoys me toalmost as much as Gary's facial hair

LadyBeagleEyes · 12/06/2013 22:48

I thought everybody knew the birth mother could change their mind at any time?
It's been a staple of the soaps for over twenty years which is where I acquired my only knowledge TBF.Wink
I stopped watching them long ago as they're so depressing, but if I was watching that scenario it would have have been so predictable.

Locketjuice · 12/06/2013 22:59

How confusing!!

To think it actually happens in real life Confused crazy!

NotYoMomma · 12/06/2013 23:12

Im pregnant with my last baby now but as the adopted daughter of a fantastic Mum and Dad who sadly had fertility issues I would 100% be a surrogate.

Could never imagine doing what Tina has

heart aches for Izzy!
