To think Sainsburys should have done more than this?

On Saturday I was in Sainsburys and as I was leaving the checkouts I stood in a security large pin(about an inch and a half long) which went through the sole of my shoe and into my foot.

Hubby pulled it out, I was bleeding, my pink suede pumps were ruined, and I dropped my handbag spilling the content everywhere including one of a pair of Victoria cameo screw ins I'd taken out earlier because they were hurting my ears. One of the checkout supervisors came over took the pin and said 'oh we were looking for that' and half laughed. A first aider cleaned up my foot which really hurt over the weekend but is better now.

Sainsburys can't find the earring. I've called in a couple of times asking and looking for it myself and have been told someone would call me to discuss the incident.

They did ring and offered a reference number for my insurance. No apology and no offer of any kind of good will gesture. When I raised it with him he said that they wouldn't offer any kind of gesture as it would admit liability and I could take it up with head office.

I'm a bit pissed off. I think a "We're sorry, here's a £50 voucher.." would have been a good gesture to make a loyal customer.

So mumsnet, am I being unreasonable to expect it?

There is your answer. Liability. Compo/Claim culture.

Process through your insurance, if you feel you must.

YANBU. They are worried you will sue them. I would. Google personal injury solicitors in your area.

Yes. For the reasons that the man told you: they'd be opening themselves up to a lawsuit.

I'm really sorry that it happened, though. It sounds horrid.

The earrings are probably long gone. The floors in Sains are cleaned using a ride on sucker thing every evening.

Yikes! did the incident get logged in an accident book? I'd insist on the price of new earrings plus at least £100 in vouchers for injury. Outrageous!

Ear rings should be covered on house insurance, not sainsburys fault the clasp on the handbag was inadequate.

As it goes I've got no intention of suing. I do intend a strongly worded letter to HQ though.

Was the incident logged in an accident book? Did they ask for your details? To be honest you will need to go through head office. The very least I would be asking for is a replacement pair of shoes and earrings.

On a completely practical note Rowan, is your Tetanus up to date? Sounds nasty & you would do well to write to HO.

Do companies not do a 'without prejudice' offer nowadays. It's been a few years since I worked in retail but I do remember doing a letter with a gift voucher encl for an incident and having to put this.

Sounds nasty, I would have fainted I think Blush if I was your DH.

You weren't asking that at all in your OP, you were expecting a £50 goodwill voucher and asking if you were BU to expect one.

Shit happens, has your leg fallen off? Have you got blood poisoning? Has treading on the pin so affected your quality of life for ever more that you need an ambulance chaser company to get you compo?

Erm I've already said I've no intention of suing but did expect an apology for the pin going through foot.

Anyway, thanks to those who took my post as it was intended.. Yes an accident form was filled in and my details taken Prozac and I've had a tetanus this year after being bitten by a dog at a funeral Mog (another story..) And before you say anything Holly I'm not suing the owner of the dog either.

Actually, it doesn't seem like anyone apologized as they were sooo scared of admitting liability and that is shit. Not everyone wants to sue they just want a godamn apology and replacement for items damaged/lost not a pre-emtpive strike about lawsuits or dismisiveness. arseholes. Hope you bollock them

I think I get these kind of things when I'm really happy. It's like the universe has to balance things out.

I worked in Next as a temp when I was a teen, in training we were told never to say sorry to a customer if they had an accident as this would be admitting liability.

Sad but it's the world we live in - people are out for what they can get (not saying you are)

actually ask for their insurance details and claim via their insurance - why should you claim via your insurance.

they should replace your shoes and your earrings at least.

I would have expected more. My DH cut his hand (superficially) on a bottle of olive oil in Saindburys about a year ago. It seems that there must have been a previous glass breakage that wasn't cleaned up properly and as he picked up the bottle a remaining glass shard cut his hand.

Anyway, first aider gave him a plaster, wrote his name in accident book and then he emailed head office once he got home.

£100 cheque in the post!!

So email head office!!

I once complained to Sainsbury's about how nasty their cough mixture tasted and they sent me a £5 voucher!

I guess their reticence must be something to do with legal difficulties if you try to sue them.

Its a bit shit op, the least they could do is pay for your shoes, earings and bung you a bit of free food. That sounds as though it was really painful.

Why should they pay for you earrings? You should make sure the clasp on your bag works if you're going to carry them around with you. You need to claim on your own insurance for that. I'd be asking them to replace the shoes though, but that's as far as I would take it.
