Is my Boss being unreasonable regarding my work hours?

bengal38 · 08/03/2013 21:39

I work 16.25 hours a week but I am on 20 hours a week to include overtime. I start work at 10 and finish at 3pm. Last 2 weeks my Boss has told me my new start time is 930 which is fine. I have 2 kids and need to leave at 3pm to pick them up but my Boss said I can't leave until 315pm. That would make me late going to both schools. I told her this and she said she doesn't care as work has to be finished. A new girl has started last Monday and she is allowed to leave at 3pm and she has no kids to pick up. What should I say to the Boss on Monday?

Is this still the same job that's been causing you difficulties for ages?

HollyBerryBush · 08/03/2013 21:45

Your hours will be laid down in your contract. Has there been proper negotiation to vary your contractual hours?

You can bring in dicrimination laws as she is preventing the right to family life and discriminating againt the principle childcarer

Have you managed to sort out all the other issues you have with work ?

LadyPessaryPam · 08/03/2013 21:56

Are you the dinner lady with the portion control problem?

PureQuintessence · 08/03/2013 21:59

Are they trying to push you out of your job, with all the difficulties you have been having, and have hired your replacement (the young girl) already?

annh · 08/03/2013 22:08

Oh not again, seriously you have posted so many times with so many problems about this job and do not seem to have taken on board any of the advice which people have given. The other employees working hours are irrelevant, she is on a different contract to you. Have they issued you with an amended contract to reflect the new hours? Are they paying you for tis time?

bengal38 · 09/03/2013 09:57

I am in the same job but a different school

How many days do you work?

bengal38 · 09/03/2013 10:17

I work Monday to Friday

OP posts:
flumperoo · 09/03/2013 10:23

What does your contract regarding hours?

flumperoo · 09/03/2013 10:27

What does your contract say regarding hours?

bengal38 · 09/03/2013 10:30

My contract says I should work for 16.25 hours a week but the Boss has put me on 20 hours per week for over-time

OP posts:
Montybojangles · 09/03/2013 10:31

So you are being paid for 20 hours, but working 25 hrs+??

flumperoo · 09/03/2013 10:33

Isn't 10am - 3.00pm 25 hours? Or does that included an hour's break? Can you work through your break? Doesn't your contract stipulate times?

bengal38 · 09/03/2013 10:33

Yes that is correct

OP posts:
HollyBerryBush · 09/03/2013 10:34

So you are getting 3.5 hours overtime?

Have you actually talked this though with anyone? ie HR, the head teacher etc

Is this an external catering company or are you employed directly by the school?

bengal38 · 09/03/2013 10:35

We get a half an hour break which is not paid. We are not allowed to work through our break. I was working from 10am but now for the last 2 weeks have been starting half an hour earlier. My contract does state 16.25 hours per week

OP posts:
bengal38 · 09/03/2013 10:36

We are employed through through the council to work in the school

flumperoo · 09/03/2013 10:37

Surely if he's asking you to work more than your contract states, you can just say no? No?

firesidechat · 09/03/2013 10:38

I remember your other posts about this job. Is it still working in the kitchen? I have some understanding of this type of job because I also worked in a school kitchen years ago.

I'm not trying to be mean but just wondered if this is because you're not getting the work done in the allocated time? Kitchens are very hard work and from what I remember of it (long time ago now) you need to be quite speedy to get everything done in time. It's not for everyone OP.

bengal38 · 09/03/2013 10:40

I am in the same job but a different school. I do get the work done on time. You firesidechat are not there and are not in my position.

firesidechat · 09/03/2013 10:43

Sorry to upset you Op. There may not be many posters on here who have worked in a school kitchen and I was attempting to be helpful. Think I will leave you to it now.

bengal38 · 09/03/2013 10:45

Firesidechat my post wasn't about me being slow in the kitchen it was about the Boss saying to me I can't leave work at 3pm to pick up my kids from school. Even when we are done by 245pm we have to stay behind to do some cleaning which is totally unfair on me as the new girl can just get up and go and has no kids to pick up.

Montybojangles · 09/03/2013 10:48

But you were already working over your contracted hours doing 10-3 surely, that would add up to 25 hrs, minus 1/2 hr per day = 22.5 hrs, so you were doing 2.5 hrs for free. Add on the 1/2 hr early start, and the 1/4 hr she wants you to go later and that is another 3 and 3/4 hrs over your overtime!!

You just tell her I am paid for 20 hours per week, thats 4 hrs per day, plus 1/2 hr break. If you want me to start at 9:30 fine, but I will be finishing at 2pm. That's what I'm payed for, that's what I will do. if she has an issue with that speak to the councils human resources. I don't understand why you have been doing this. Occasionally I might understand (work for nhs so do it myself), but daily is unacceptable.

You also join a union.

Lilithmoon · 09/03/2013 10:49

Talk to your Union rep. OP. They will be able to give you advice directly related to your situation.
