to be really upset and want a full refund as item not as described?

Hi,

I bought some baby clothes off eBay that were described, as all in immaculate condition, and hardly worn. When they arrived, most look worn out and certainly don't look like they have hardly been worn. There is no way I am paying to post them back (postage would cost £10+). Would it be unreasonable for me to ask for a full refund (incl postage cost) and ask the buyer to pay for postage if he or she wants them back?

Have emailed buyer to say lets resolve this before I open a case, but I doubt he/she will reply as has been ignoring by shipment emails - the package arrived late and shipment confirmation email wasn't sent.

If you open a SNAD case Ebay/Paypal will tell you to post the items back at your own cost (trackable too so seller can't say they didn't arrive) before you get a refund. And sellers don't have to refund return postage, although good ones will. Good luck :)

Ebay don't realy care you will have to pay to return you may get money back for clothes but not post has happened to me a few times im trying to stay away from ebay now as they are not helpful to buyer :(

Open a case and explain that seller won't respond. I had this recently and ebay sent me a pre-payment label so I wasn't out of pocket. You could always investigate cheaper couriers.

Yes Ebay can be really good. I received an item that was the wrong size and after trying to sort it out with seller I opened a case with ebay. They tend to go on the side of the buyer alot. I was refunded and sent a prepaid label to return item. I opened a Item no as described case.

I opened an item not as described recently and received a full refund despite suggesting a partial refund would be acceptable.

Don't be put off ebay. I sell and there are lots of good sellers - I always refund the postage. Sometimes it's worth looking at feedback before you buy off anyone and always make sure you leave feedback good/bad.

Ive been put off Ebay as a seller sold me a damaged item and to send it back it would cost nearly £6 when the item only cost £13.

Ebay wouldn't help.

you never know they may offer the refund to prevent negative feedback.
ebay can be a bit hit and miss which is frustrating.
if you are still after clothes try googling your local area to see if there are any second hand/ preloved shops.
I run an online one so im sure there are others

Watching with interest, after a local buyer sold me a garment described as 'excellent' and 'hardly worn' which clearly was nothing of the sort. Unfortunately I paid cash and left it a while before leaving feedback, which was when I looked again at the description and contacted the seller, knowing they take exception to critical feedback without having been contacted first.

Seller isn't having any of it despite me opening a case. I think TK Maxx may be the way forward.

If an item is misdescribed or faulty, return postage is the legal responsibility of the seller under the Distance Selling Regulations. If you are simply exercising your right to return under the DSRs without the goods being misdescribed or faulty, that is when you can be required to pay postage.

It can be difficult to enforce, but it is possible to get your money back if you kick up enough of a fuss. Legally, you are in the right.

I got a full refund in the same circumstances from eBay. After getting a 'tough' from the seller I wrote a really snotty complaint about the seller breaking eBay rules by describing an item as in excellent condition when it wasn't. I didnt have to send them item back. They said it was a goodwill gesture.

You all sound like you've had a nightmare. Buy off me Grin. I'm a A* seller. Some buyers can be just as bad as well, not paying and blanking your messages. I just sold my wedding dress VERY cheaply - they got it at a steal. It specified pick up only. As soon as they bought it they asked me to post it, I said no (too bloody big!!), then they said they were coming to get it and texted me to say they couldn't, then asked me if I work in central London and can I lug it into work with me. What part of pick up only they didn't understand I do not know!! At least you can leave a seller bad feedback but a buyer can not pay/arse you about and you only get the option of good feedback. Ebay can be a bit of a headache sometimes.

The problem is that it's subjective though, isn't it. Someone else's 'excellent' condition may be my 'bobbly and past its best'.

Sellers who list any old shit really boil my piss.

eBay have told me to pay for the return postage myself and return the items, then they'll issue the refund (but not for cost of posting it back). It is extremely unfair! Hmm

You can send back using collect plus , should be 4 quid ish and its trackable.

Yy, buttery, now's the time for the arsy email asking why you should have to be out of pocket because of some seller listing any old shit and calling it 'excellent'.

If an item is not as described then you don't have to pay return postage. Email eBay and quote the Distance Selling Regulations that vigilante mentioned above. When I did that they issued a pre-paid label for me to use to return the item.

DSR do not apply to auctions or private sellers

ebay can not make sellers pay return postage, they should if they are at fault

but DSR's only apply to most BIN ( not perishables personalized items; items with use by date like concert tickets/ vouchers)

if you win an item that was sold in auction format even from business seller DSR do not apply as all auctions are considered second hand goods

private sellers with auctions may have to accept returns due to ebay rules for misdescribed/ faulty damaged goods but they do not have to accept returns for change of mind which BIN in a business do,

OP maybe able to ask ebay for no fault refudn ie she gets money back without need for return but otherwise she will need to return and then get refund
