To not want to pay hospital parking fine !!

Baffledandbewildered · 06/02/2013 12:30

I had an appointment with my consultant on Monday.( I have a life threatening condition so it is very important I do not miss appointments ) . I arrived 20minutes early to give myself time to park in a disabled bay ( I do have a badge !!!)
The hospital had decided to close the main car park for the hospital so it was chaotic . I kept driving around but could find nowhere to park in a disabled bay. As a last ditch attempt I decided to park in the other car park but there was a huge queue, so I would have missed my appointment :( . As I needed to see the consultant urgently I decided to park my car at the end of the disabled row displaying my badge. It was not causing an obstruction and I went. To my appointment.
I had to wait over an hour to see the consultant but as they do various tests sometimes I didn't feel I could leave to try and move the car. Anyway when I returned to my car I find I have just been given a ticket !!! I understand why they ticket but would I be unreasonable to think it is unfair given these circumstances and not pay ??????
Also car park was shut but they were not doing anything to it !!!!

Was it a private car park Baffled?

If so, ignore.

BettySwollocksandaCrustyRack · 06/02/2013 12:33

Can you appeal? Who issued the ticket?

Baffledandbewildered · 06/02/2013 12:37

I have no idea if its private, the ticket was issued by total parking solutions and it doesn't say on behalf of nhs trust or anything . Also just seen it states car colour is black when my car is a light mink ( yuck) colour . It's £30 for the fine :(

Sounds a bit unfair. I would appeal it.

madasa · 06/02/2013 12:37

You have no obligation to pay a 'fine' if issued by a private car parking firm.

I was 'fined' 16 months ago after parking 'incorrectly' in a supermarket car park.

I did a lot of research and found out that only the police or councils can issue fines.

I ignored it completely.

I received a lot of threatening letters....threatening court etc.

I keep them as a momento. I have heard nothing for about 8 months now.

ratspeaker · 06/02/2013 12:38

It will depend on who issued the ticket and why it was issued,
I presume your badge was on display
Were you parked on double yellow lines?
Was the ticket issued by council wardens or private firm?

LittleChimneyDroppings · 06/02/2013 12:40

Just looked, it's a private company here

Ignore it.

ImKateandsoismywife · 06/02/2013 12:40

Yanbu. I thought if you had a blue badge you were allowed to park anywhere as long as you don't cause an obstruction?

Cortana · 06/02/2013 12:40

Seems they're private. Link Here. Seems like the usual ignore tactic as it's not council.

madasa · 06/02/2013 12:40

As far as I can see they are a private firm.

Am no good at links but there is some good advice on Martin Lewis money saving site.

If you google private car park fines or suchlike you will find a wealth of advice.

Hobbitation · 06/02/2013 12:41

I wouldn't ignore it, would worry about them getting CCJ against me. Would write & appeal it.

hellhasnofurylikeahungrywoman · 06/02/2013 12:41

Total Parking solutions? They sound like a private company, ignore it. Do not appeal it, do not enter into any correspondence with them, see this thread on The Consumer Action Group site

madasa · 06/02/2013 12:41

They cannot get a CCJ against anyone....they have no power

hellsbells76 · 06/02/2013 12:42

That's a private scamming bunch of bastards profiteering from sick people and NHS workers I don't know how the cunts sleep at night parking firm. Ignore ignore. Not worth the paper it's scrawled on.

Nancy66 · 06/02/2013 12:43

Definitely ignore. they will continue to write to you and make threats but they have absolutely no power to enforce the fine.

Crinkle77 · 06/02/2013 12:45

Also it may be unenforceable if they have the wrong details about your car

madasa · 06/02/2013 12:46

Somewhere I found images of the various letters they will send and in what order (mine was from Europarks) and sure enough they came in exactly the same order....each one more threatening than the last.

Ignore...ignore...ignore line cat litter tray/budgie cage with them

chocoluvva · 06/02/2013 12:47

They're probably a private company employed by your regional NHS.

If you have cancer there might be someone who will deal with your ticket for you. (My local cancer hospital has a fab lady who does this)

I sympathise - what else can you do? You can't just abandon your car in the road while you go to your appointment.

JaxTellerIsMyFriend · 06/02/2013 12:47

We got one of those tickets from a private parking firm. It looks like a 'proper' parking ticket, but actually its a scam from a bunch of sheisters.

Ignore!

Baffledandbewildered · 06/02/2013 12:47

Thank you for all the above replies . I think I will ignor it ( very nervous though !!) yes my front wheel was just on the new red line but not blocking the road as this is a seperate area not a through route . I just feel like people are being set up for fines by car parks being closed and long waits to see doctors :(

chocoluvva · 06/02/2013 12:51

I know. I parked on the side of a road that I thought was okay till I got a ticket. Very close inspection of the road revealed a few faint dabs of yellow paint, which were double yellow lines once upon a time.

Ask at the hospital, especially if you're going to be attending frequently.

hellsbells76 · 06/02/2013 12:53

Good for you. I wish hospitals would stop colluding with these scam artists.

madasa · 06/02/2013 12:54

Baffled I was very nervous as things like that usually freak me out.

I did my thorough research though and decided that I wouldn't be bullied.

I just put each one in the drawer and forgot about it till the next.

They did make me laugh though as they increased my 'fine'

I then received a letter headed 'This will not go away' oh yes it will

They gave me 5 days to pay x amount

I then received another letter giving me 7 days to pay a lesser amount!

ENormaSnob · 06/02/2013 12:55

I would be careful with this tbh.

My friend got one at the hospital and was taken to court.

Think it was a trust one though not a private company.

Could you appeal?

Hobbitation · 06/02/2013 12:59

Anyone can go to court and get a CCJ, if they can prove the terms of parking were made clear and that you breached them, and that they have acted reasonably, followed procedure with documents etc. Of course some of these companies will fall foul of one or more criteria. But don't simply say parking tickets on private land are not enforceable or always unreasonable.
