AIBU to not give 2 months notice?

I think I need to pull my DS out of nursery. What do I do?
So far I've paid £320 deposit plus a month in advance but the contract says I need to give 2 months notice.
DS has not yet started there but I've spent 10 hours or so trying to settle him in and he hates it, so much so that he's become very clingy and insecure even at home. I would persevere if I had confidence in this nursery but after spending all these hours in there with my DS I am not happy at all with what I've seen. The staff are mostly uncaring and they let the children cry a lot, especially when they wake up or if they don't go to sleep like they think they should; they hardly try to entertain the children at all and they children get bored of playing by themselves and start to cry; a little girl was crying so much that her nose was bleeding and they didn't even take any action or record it in the accident book. I am distressed at the thought of leaving my child there Sad.
Would I be unreasonable to write a letter and explain all of the above and then say I don't think I owe them any more money considering the awful stuff that goes on in there and the fact that DS hasn't even started there and I've already paid a hefty deposit plus one month in advance?
Please be gentle. I'm feeling quite anxious about all this.

yes you need to take action.

not sure how to proceed, especially regarding to get your money back, but that level of negligence is alarming!

I would talk to the head, raise my concern and ask for my money back.(pull out DS of course)

you can also mention that you are concerned enough to report them to Ofsted if state run - not sure about private ones, I think they get Ofsted reports too.

I'd probably try to talk to the other parents too - you'll be the judge of that.

Don't pay any extra, also contact ofsted.

What does the contract say in the context of ratios, stimulation, care, etc.. Can you prove the nursery is in breach of the contract. I would chalk it up to experience at the cost of the deposit and the month you have paid already. They are unlikely to sue you for the additional month and if, when you give notice, you state the ratios, the lack of stimulation and your disappointment with the care levels and state dates and times of when these things have happened they are unlikely to take the matter further.

I know. Poor children. They all look so miserable, even the ones who don't cry that much. :-(
