to think we should have been offered a replacement??

We bought a great Phillips juicer back in September. It's been amazing, used every day. Bought for the bargain price of £64.99. Very very pleased. It developed a slight fault, and since it was purchased from Ideal World we called them. Oh yes, they said, send it back and we will replace.

Several days later, we have seen a credit to our bank account for £64.99. We phoned, and they said they had no more in stock, so would phone when back in. Here's the thing....it IS in stock, just not for the sale price any more! It's back up to £80!

AIBU to think this is a bit wrong? Surely they should have just replaced the item rather than say that it's not in stock then try to get us to purchase for the full price (and pay P&P again)? Can anyone tell me if I can insist on having a new one for the sale price, or are they within their rights to do that?

I have just looked at their policy

'Damaged/Faulty: If the product is damaged/faulty or the wrong item and you require a replacement, please contact Customer Services on 08717 123 456 to arrange collection. Please enclose the supplied Returns Slip giving details of the damage/fault. The product will be repaired or replaced and sent back to you free of charge. If no replacement stock is available, a refund will be issued. Calls cost 10p per minute plus network extras.'

So although morally wrong to do what they have, in their T&C's it looks like they can do that.

They really could have replaced it couldn't they! YANBU but I suppose it's within their rights to give you the money you paid for it. Phone customer service and ask them if they will reconsider.

But they DO have it, that's the thing. It's just not at the sale price any more.

Shops make profit whether something is in the sale or not. You think they are refunding the money in the hope you will go and buy at full price? I doubt it.

They probably didnt have stock at the time and getting payment back from you and dispatching a new one will cost them in admin now they have stock again.

Its 15 quid. Go buy a new one.

It's definately been in stock. Bit of a cheek but given my last transaction was less than great I've learned not to use them again.

Glad 15 quid is so trivial for you ;) sadly not for all of us!

Take the money and buy a new one from another shop. That'll teach 'em.

YANBU. Play.com did the same to me when i purchased a DVD way before Christmas, when it came it would not play, there was some kind of fault. They refunded me the money (it was on half price) rather then give me the DVD that had gone back up to full price over Christmas. When i asked them about it they claimed it hadn't been in stock yet a good friend of mine brought it at full price the day after I sent mine back and the store registered it as being able to buy!

Cheeky beggers aren't they! Well we've got the same one, cheaper, from coughAmazoncough.

I love that people are assuming that because we could do 65, that another 15 is so paltry to us. It was a luxury and saved for! It's not even about the money, but the action taken that seems morally off.
