To expect compensation from Currys for selling a second hand laptop as new "non pristine"

I have just purchased a "non pristine" laptop from Currys in Croydon which was described as simply being without a box or power cable. The assistant assured me it was new and had been on display.
Now that I have plugged it in I have found many documents, payroll details, staff reviews, training and many other files which point to it being used by Currys from late 2007 to early 2009.
I had to call the store twice to get a callback from a manager and having spoken to him I can quite understand all of the negative publicity this company receives.
Firstly he asked what I paid for it (£150) and then pretty much said what did I expect for that price. I said it was sold as new, unboxed and without the power cable but otherwise new. He then denied that pristine means new and said I wouldn't find another one for that price.

When asked what I wanted - I said a full refund for the computer, the charger unit I bought elsewhere and the anti virus software I bought from them at the same time. Also compensation for my travelling to buy it, to return it and for the inconvenience and telephone costs to 0844 numbers.

He offered to refund in full & as a gesture, a 15% discount on a brand new one and said if I wanted anything else I must write to their head office.

Am I being unreasonable to expect such a blatant breach of the sale of goods act to be taken more seriously by a major store. Is it unreasonable to expect more than just a "sorry about that - do you want your money back?" type response?

I feel really angry as this is a xmas present that I am now unable to give and I also have the hassle of returning it!

I'd just expect him to be more concerned and apologetic than the OP is describing. If I were him, I'd be thinking oh SHIT!

Sounds like a breach of the data protection act to me, I'd ring the information commissioner and ask them!

I think the personal files are an issue.

The one of the lap top not so much. You don't know how old t actually is from some files.

Compensation for your time? Ha ha If you were in any kind of job where you time was so valuable you wouldn't have bought a £150 laptop!

im sorry but they cant sell a laptop described as "new" if it has all the staff info/payrole/documents etc on it... they've been using it... therefore it is 2nd hand

yanb write to head office and explain. if you dont get anywhere with them take it to the dm... they will defo love that story Grin

Give him some of the details you've found on it and suggest he make an offer and say you're going to offer it to several newspapers as well.

Oh my god ... that is a data protction nightmare. Report them immediately to the Data Commissioner via the Information Commissioners Office. God knows how many other breaches of DP there have been if this is what they are doing, and this is the only way to stop people being flippant with data.

Imagine if this was your payroll info available to anyone!

I'd give data protection a call as well or publish all the files on the internet

FWIW I think pristine could mean in as new condition, but they should have wiped all the data first.

I can't imagine you'd get much more than what they have already offered you - ie a full refund for the laptop.

The data protection regarding the staff details is another matter and could be a big breach of data protection, etc. That needs to a whole different isue and I am surprised they are not wanting it back asap!

Thanks for the views everyone, I think I'll give their HO a try although I don't hold out much hope.

Interesting the number of people who think I shouldn't be compensated because "shops don't do that". Goes a long way to explaining why shops with crap service are still thriving!

I'll probably just take the refund and then buy a similar one on ebay for £50 as I will never subscribe to the view that a laptop is worth £150 whatever the spec.
