Today some idiotic lorry driver crushed the top corner of my car door whilst I was stood in the road putting things in my car. I had been stood strapping child in And putting things in for approx 3/4 mins before this happened.

Lorry driver misjudged the space and badly crushed the top of my car. He got out refused to take blame or swap details. And said I was to blame.

I've contacted insurers and his company, company say im to blame to.

I want to contact the police about this as feel he was driving dangerously etc and could have killed me as his lorry caught my door just centimetres from my head.

WIBU to ring 101 about this

I don't think you have any choice. So far as I'm aware, he's committed an offence by refusing to give his details.
Also, I don't see how it can be your fault when you were stationary. Unless you were parked in a dangerous place.

so your car was stationary and you were not in it?

if that was the case I'm not sure how anyone but the other driver is to blame unless you where parked illegally.

I believe this is the sort of thing the 101 no is for.

I think you could give them a call just to see if you have a case, I'm sure they won't mind. I have to ask though, why were you strapping in child and putting things in your car from the road side?!? That is never safe and I think his company may have a point.

Yes, I would ring the police non-emergency number and see what they say. If he refused to give details and then left the scene of an accident he is guilty of the offence of failing to stop/report accident. He falls precisely in the first category of this and it carries a financial penalty but also, most importantly, 5-6 points on his licence.

Did he crash into the door that was open in the road? If so, you are liable as you are the one with part of your car in the road. However he is breaking the law by not giving details.

You are nbu. It was totally his fault, it is. It for you to jump out of the way of a lorry driving down the road it's for him to remember he is a professional driver. I can't believe this is a large company. What if you had been broken down? Or still holding your baby?

Oh and btw dh is an advanced driver before anyone's comes any rubbish, he will be appalled.

He crashed into open door. Leaving it rather mangled. Was putting stuff in from roadside as I had to park close to my friends fence so I didn't block the road too much.

Hadnt parked illegally

If id have moved out of way if have been crushed as he had no signs of slowing or stopping so decided best to stay put and not move

So you were standing in the road, with your door open, and the lorry driver hit the open door?

sorry but I'd be a bit annoyed as well if I'd crashed into your open door which was blocking the road.

It is a drivers responsibility to spot hazards and act appropriately. Eg slow down or stop if necessary.

If a child fell into the road and the lorry driver hit it would it be the childs fault for blocking the road? Hmm

I'm fairly sure you aren't meant to just plough on regardless if there is an obstruction (i.e. someone at their car door) in the road?

I think he is at fault regardless of where you were parked you can't just drive into someone Confused
