Do I have a case for suing WAITROSE? Their packaging is LETHAL!

I am mighty cross.

I wanted mackerel in tomato sauce for lunch, so I laid out my sliced bread on a large dinner plate, and proceeded to open the tin of mackerel. The tin sort of exploded and splattered tomato sauce all over my hands, and my beautiful white Per Una (yes, really) top, with beads and embroideries - ethnic gypsy look I should imagine.

This was caused (I gather) by a combination of two things:

  1. Too much runny sauce and too little actual mackerel.
  2. Dinky little tin which opened unevenly. (Essential Range, so probably sub standard material)

Now, less than a year ago I managed to stab myself through a Waitrose ice cream tub, again flimsy, not like Cart d'or! The knife just went straight through both ice cream and tub and I pierced my finger.

I think I should perhaps avoid Waitrose in future, as their packaging is clearly a hazard to health and safety, and a danger to fabrics of all kinds.

But, do you reckon I can ask them for compensation for a ruined top?

(I have so few naice clothes, so it will be sorely missed, unless I try dye it maroon?)

WWYD?

I have to confess I microwave ice-cream tub for 20 secs. Makes lid easy to remove and then the ice-cream isn't all frosty.
Don't like frosty ice-cream.

QuintessentialShadows · 27/09/2012 12:20

That is actually the only good reason to get a microwave that I can see!

Quite right Quint, quite right.

KenLeeeeeee · 27/09/2012 12:21

Are you in Scotland?

SlightlyJaded · 27/09/2012 12:22

I am sure Mr or Mrs Waitrose Manager would be glad to grovel at your feet refund, and then some, if you stomp into your local branch brandishing tin and top and looking scary.

And then a letter to head office about your two encounters with sub-standard packaging.

That's what I'd do.

WilsonFrickett · 27/09/2012 12:23

There you go then, get a microwave and buy the niacer mackerel. You know, the ones that are canned in golden leaf. Sorted.

Capiche?

cumfy · 27/09/2012 12:23

Oh, one of those tins.

Did you push and push and splat ? :)

samandi · 27/09/2012 12:24

Surely you just wait a few minutes for the ice cream to soften? YABU with regards to that. Not sure whether you are being unreasonable about the tin exploding - perhaps you just need to be more patient and careful when opening things?

QuintessentialShadows · 27/09/2012 12:25

YES cumfy, EXACTLY that tin. It is dangerous. It does not budge, and you apply more and more force, and then SPLASH!

Ocapitcho

Why would I be in Scotland? Do Scots like mackerel and strawberry ice cream?

pollyblue · 27/09/2012 12:25

I had a gone off pouch of cat food explode its contents over me once - just as i was thinking 'hmm this pouch feels a bit overblown' bang the bastard showered me in rancid felix.

Not naice.

JustFabulous · 27/09/2012 12:27

Knife + ice cream tup = your fault.

Tin + messed top = your fault for not knowing you should always open the tin slowly, sway from you and not when wearing a white top.

StillSquiffy · 27/09/2012 12:28

Tsk. Frozen Ice-cream. Dangerous stuff.

Tell them mackeral was off, which presumably it was in order to generate mount vesuvius in the confines of a London kitchen. Take manky mackeral with you (along with now-manky M&S jumper) to nearest Waitrose (after ensuring it is of course 'off') and await to be anointed with money off vouchers. That's what they do at ASDA (allegedly)

OhSoSimple · 27/09/2012 12:28

They will refund. My mother's trousers got caught in the trolley wheels and it left them with a black stain. Waitrose asked her to bring the receipt once she had purchased a replacement pair and they refunded immediately with no fuss.

Please don't buy essentials anymore it is not good Waitrose etiquette.

worldgonecrazy · 27/09/2012 12:34

Take top to nearest Waitrose to get them to say sorry and hopefully offer you goodies to make up for it

Then take top home, handwash, and leave in sunlight for a few days. Tomato stains will magically disappear so you will have goodies and top.

MichaelFinnegansWhiskers · 27/09/2012 12:41

Do I understand right, you held a tub of ice-cream in one hand, and stabbed it with a knife with the other? Shock

I have long and bitter experience with those tins although mine come from aldi - you need to hold it with one hand over the top of the lid, so that when it suddenly comes off, it's stopped after a few millimetres by the hand in the way. Iykwim. Doing it that way also naturally directs any spurtage perpendicular to you, rather than at you.

TheProvincialLady · 27/09/2012 12:43

Feel free to sue Waitrose by all means, but you will have to stand up in court and admit that you are really, really common and shouldn't be allowed to shop there. They only have the Essentials range to sort the wheat from the chaff, and ice cream packaging is designed to injure anyone who hasn't used a Kath Kidston ice cream scoop.

Capri?

QuintessentialShadows · 27/09/2012 12:46

Capress!

Well, that little bit of creativity did not work. Hmm

OP posts:
quoteunquote · 27/09/2012 12:49

soak top in cold water with bio tex it will come out.

ajandjjmum · 27/09/2012 12:53

Buy soft scoop icecream!

When I have returned items to Waitrose on a couple of occasions - Essential minced beef and Sirloin steak - they have refunded the cost and given me a new pack of the product.

But I love Waitrose because I won their monthly store raffle a couple of months ago, and now have over £200 of John Lewis vouchers to treat myself with!! Grin

cheekybarsteward · 27/09/2012 12:56

Who "waits a few minutes" for ice-cream to soften? Hmm

Startailoforangeandgold · 27/09/2012 12:57

Wash top put it out in sunshine while still wet.

If not perfect rewet and repeat.

The effect of UV on tomato stains is magic.

And in future remove top before removing pull ring tops.

DDs think mum opening Tom soap in her bra is very funny. However, I've learnt the hard way.

delphie · 27/09/2012 13:11

forget the cheap mackerel and a Per Una top "with beads and embroideries" what about the children suffering from "emotional trauma and towel shortages" caused by Kellogg's?

AWimbaWay · 27/09/2012 13:20

I get my ice-cream out of the freezer first so it can soften a bit whilst I'm melting the chocolate to go pour on top.

Once I heated the chocolate for 5 seconds too long in the microwave and it went all funny with crispy bitty bits in Sad do you think I could sue cadbury?

WineGless · 27/09/2012 13:23

Yy to sunshine removing tomato stains.

If you can find any send some our way won't you
