to think this is stealing? What can I do to prevent it? Have to go to the shop this afternoon - please advise!

Scooter repair shop took my scooter in in April. They told me they would provide me with a breakdown of costs etc for repair. I phoned a few times during April and May trying to pin down breakdown of costs for repair but never getting a final figure and then had a horrible incident which meant I wasn't dealing with anything other than admin relating to incident and forgot about scooter during June July August - my fault. I did put a bankers' draft cheque (because bank couldn't order me a chq book) through the door for £650 but never checked when it was cashed. But had also never received any breakdown of costs for repair just an approximate figure over the phone back in April. Start of September I get a note saying someone has applied for VC5 registration of scooter. Arrangement was that the scooter repairs place (also a specialist Vespa shop) would sell it and take commission so this is what I thought had happened.

When I rang the chap said they'd never received my cheque (my DP says he put it through - even described how the hinges of low letterbox almost took his fingers off - bt having now checked chq was not cashed?) and they were applying to take ownership fo scooter because it was costing them storage. I go into shop, pay for repairs plus MOT etc (now £750) they say they are being kind by not making me pay storage. I'm too worn out to argue. I just want my scooter fixed and sold which I thought I had sorted out.

I phone up DVLA this morning and the shop haven't withdrawn the application to transfer VC5 despite the fact that I have paid for repairs (which haven't been done yet - only paid a week ago) and despite the fact the chap was going on and on about contacting me and I pointed out to him where he had taken down the wrong telephone number for me on the form and asked why no one had put anything through my door (I live a 30 second walk from the shop - they picked up scooter from my flat - I'm on the ground floor with own front door) and it sounds like they may have lost the booking form and becuase I wasn't chasing them they were ringing wrong numbers and couldn't be bothered to walk 30 seconds to my door on their side street!

DVLA have advised the only way I can stop ownership of scooter being transferred to them today is by reporting them to the police for theft! The shop say oh don't worry we will just transfer it back to you once we have been granted legal ownership under Vc5 (happens aumatically by end of day according to DVLA) but I will have to trust the shop to do that and I am not sure I can trust them now even if not malicious they seem terribly organised. They think they are doing me a favour not charging me storage for a scooter I thought I had paid for repairs for and had been sold!

AIBU to think this is all a bit of a scam now since they haven't withdrawn application for VC5? Have no idea what to do or get DVLA to stop transfer of title - any ideas?

Octopus when you get a bank draft you pay for it immediately (as outlined above).

If it's not cashed you will have to report it to the bank so that they can cancel it and refund you the money.

Given how incompetent this shop has been, I'd be doing that immediately - can you imagine if they find it under the doormat while it's still valid?

They might lodge it into their account, and then how long will it take them to refund you!

A bank draft is pretty much equivalent to cash. I don't think the OP can cancel it without taking the original draft to the bank and even then it will take some persuasion.
