Ok first time starting a thread in here but I can't decide if I'm being unreasonable or not so here goes:

I ordered some salmon from a fishmonger to be delivered early Sept, I got home last Wednesday afternoon and found a card in the porch saying I'd missed a delivery and they'd left it in the wheelie bin, opened the bin to find a bag of salmon, I read the note again and it was dated the Monday, it had got stuck in the letter box and was only pushed through by the postman on the wed, I rang the company up and explained what had happened and said that I didn't think a bin was an appropriate place to leave food deliveries, she said the drivers can leave them at their discretion and I should've been in etc.

Left them looking in to it, I've today had a letter stating that as I'd agreed the delivery date and wasn't in (I'd got dates mixed up, they usually deliver on a Friday), driver was in the right to use his discretion and I owe them £28.

My argument though is that even if it'd only been in the bin half an hour not 2 days I still wouldn't have eaten it, I just can't see how they think leaving fresh fish in a wheelie bin is ok.

So AIBU to tell them to piss off they're not getting a penny or should I pay up?

Yanbu, who the fuck puts fresh fish in the bin?! Also the fact that the note wasn't put through the door properly wasn't your fault. I would tell them to get fucked!

Was a delivery time specified? I don't know really. On one hand I don't blame you for not eating something left in a bin but on the other hand, there was probably nowhere suitable to leave it if you weren't in. If it's out of refridgeration it's not safe so I guess that's why they expect people to be in.

Sorry, no help at all, I really can't decide.

Delivery was between 12-6, I'd just nipped out to do the school run (20 mins), DP was in but didn't hear the door.

Surely they would've been better leaving it with a neighbour? (who was in, when I told her what'd happened she said she saw the van.)

The bin was half full

Oh and it's the fishmongers who deliver it in a refrigerated van so if I wasn't in he could've just returned it with him ?

Your DP should have listened for the door since you were expecting the delivery and you were only out for 20 minutes.

No, I wouldn't eat bin-fish either.

He should've left it with a neighbour. Or taken it away again.

you should have been in, or someone should have taken the delivery.

BUT, you shouldn't have to accept a food delivery, a fresh food delivery to be left in a BIN.

So did you not put any rubbish in your bin from when they delivered on Monday to when you looked on Wednesday? (and only then by seeing the card)

No I didn't use the bin from Monday aft to wed morn, I used the kitchen bin, that's not that odd is it??

They broke food hygiene rules by mixing fresh produce with waste (even if it was in a sealed box - the box could have anything left on it, like animal poo, which would then contaminate your kitchen).

They did not knock loud enough.

The failed to ensure the note was placed through the door correctly

I don't see what you could / should have done more (maybe leave a note on the door saying "please knock loudly"?)

Don't pay, report them to the local food hygiene inspector, and request compensation for the take-away you had to order that night for the failed food delivery.

Write it in an email, or recorded delivery letter to them, and give them reasonable time to respond.

The bin was half full? And they put the fish in there? How would that be appropriate for any delivery? That's horrid, they could have left it on the doorstep!

Really in the bin? Awful!

Definitely need to put that as feedback on any websites they advertise on!

Perfectly normal not to go to the bin between Mon and Wed we don't go everyday.

Ooooh I dunno, there is fault on both sides here. It's totally not their fault if YOU got your dates mixed up and you're even more to blame if your dh was actually in the house when the delivery came (time to get a louder doorbell?!)

BUT the delivery driver was BU to leave it as he did. He should have hidden it behind the bin at least not in it with the rubbish. If he'd had common sense then he should have knocked at a neighbours house. He should NOT have had to go to any more trouble than that - they can't run a business if they have to constantly have to make second delivery attempts.

Ultimately they probably upheld their side of the contract - delivered the goods when both parties agreed to accept them. The fact that you did not accept them on the agreed date is your own fault (or your quiet doorbell's/husband's) so I would think they would be totally within their right to charge you. But a decent company would not charge as a gesture of goodwill (JUST on this occasion) and would then look into the policy of putting stuff in bins!

Tell them that maybe their delivery drivers should use common sense rather than their "discretion".

Who the hell would want to eat bin fish?!
