Hi all, advice needed please.

I bought a jacket on ebay (have posted in ebay but AIBU has more traffic). When it arrived, the sleeves were really short so I checked the label and it is a petite - and I am tall! There was no mention of this in the listing and obviously I wouldn't have bought it if there was. So I sent it back today and asked for refund of original cost plus all (both lots) of p&p.

This is the reply from the seller...
Hi, only just got in and seen your messages so apologies for the delay. So sorry my mistake. Thankyou for returning to me and you will receive a full refund however as stated in the listing I cannot refund return postage as this is paypals ruling due to the distance selling regulations. This is the law so the system only allows us to refund upto the maximum amount you paid in the first place. This is why it is stated in every listing. THankyou for your prompt postage and refund will be done immediately as soon as it arrived. Many many apologies for not noticing it was petite.

In her listing she says return p&p has to be paid for faulty garments - but this was not faulty.

AIBU to be really p'd off that I am out of pocket?

Hmmm, I would check out the bit about her saying it's the law, on google, I could be wrong but I'm not sure it's illegal to refund someones p+p, it sounds absurd actually Grin

She was being misleading not giving you important information in the listing, you could open a dispute with ebay about it?

Was there much information in the listing about the item?

If there's a next time, don't send the item back until you've heard from the seller because you've got no bargaining tool now it's sent back.

she's lying to you. I've had the postage refunded too, its standard when its their mistake. Tell her to pay up or you will report to ebay.

I Don;t think I've ever seen a seller refund P&P - even buying fro stores, you might get a sticky label that is prepaid to send back - but they rarely reimburse you initial outlay for P&P. It's not a bespoke fitting room they are running.

I've just looked it up, and I read the sellers letter as saying it would be against the law for them to refund you sending the item back (which would be absurd), whereas the law actually says the seller has to refund the initial p+p, but isn't required to refund any subsequent p+p costs.

Does that make sense?

I would say it would be up to the individual seller in that case, I've sent stuff back and paid the p+p to get a refund, so it's not unusual.

It's just something you have to accept to a certain degree if you want to buy online.

I recieved a pirate DVD and did a paypal
Claim- I HAD to pay if I wanted to return it. It wasn't worth my while. Your seller sounds genuine and she'll also be out of pocket. Perhaps leave feedback reflecting your disappointment in having to pay to return?

I agree with jumping to a degree, I've bought trousers that didn't fit but I haven't asked for a refund because it's just the risk you take for buying at a cheaper price online.

But the seller didn't 'notice' it was petite, which if she was listing the item properly she'd have looked it completely over to see what condition it was in/what was on the label.

She either did notice it and didn't say, or she cocked up the listing.

YABU to expect the seller to pay for your return postage. It is a long sleeved jacket, and if you are taller than average, or have longer arms than average, it would have been sensible to email the seller before bidding and ask her the exact length of the sleeves.

I did read your original post - if I wanted to purchase clothes in the 100% knowledge they would fit, I would haul my arse off the sofa, up the precinct/mall and try them on .

I take a chance on them fitting when I buy from ebay.

I do buy from online retailers - and to reiterate - if I choose to send back Sometimes they will send a label for me to return goods, sometimes they don't. No retailer has ever offered to reimburse my initial p&p costs on purchase.

So YABU to expect a seller to be out of pocket.

Nowt to do with what is stipulated in eBay policy as that's fuzzy and usually is taken to mean your costs for returning an item. Yes, you could have emailed about the sleeve length but then the seller should have stipulated that the item is petite. Check the sellers policy on her advert, as that is your legally binding contract. If she stated that she wouldn't refund P&P under any circumstances, you're stuffed. However the fault lies with her for not accurately describing the item. Negative feedback methinks...

The seller was wrong, but agree with squeaky that it was ultimately the OPs responsibility to ask for measurements.

How much was it to post ladyg?

If it was only a few quid, could you put it down to experience and save yourself a whole lot of hassle pursuing it through ebay and getting wound up?

This is why i would never buy clothes online that and im a funny shape and have to try things on i think that if i were the seller i would refund one half of the P&P for good will.

I bought something on ebay once and never received it, the woman refunded it all, i said that i would suck up the P&P. I don't know if she ever got her stuff back actually.

If the description was incorrect, as in a long sleeve jacket is not what was sent, she sent a petite jacket then surely the mistake is hers and the item is not fit for purpose the same as a faulty item would be not fit for purpose.

I have no idea of any laws surrounding it but I would say it was totally her mistake and so she should refund the p&p.

The listing should have stated it was petite. It was an incorrectly described item SOGA states that the buyer should not be out of pocket.
