He has me over a barrel?

I know, I know. My fuck up. We cant afford brand new items, we just cant, I wish! Second hand is a must.

I bought a fridge freezer from a man. I get it home and its busted, solid ice in the back of the fridge compartment with 24 hours and the freezer doesnt freeze.

I call him. Its not his problem, he says he'll call the police if I keep calling.

Fucking hate to admit it but the bastard has me over a barrel doesnt he?

And the poor stay poorer. FFS.

Where and how was it advertised for sale? You could take him to small claims court or consider reporting him to police for fraud if you think he knowingly took your money for a heap of shite.

gamerwidow · 26/08/2012 19:40

How did you buy it?
If it's from eBay then it's covered by the Sale of Goods Act.
If it's from a private seller then the Sale of Goods Act only applies to the title and description it was advertised under not to the quality of the item.

How was the fridge freezer advertised? If it was "Fridge Freezer for Sale" then there's nothing you can do but if it was "Working FridgeFreezer" or "Fridge Freezer in good working condition" etc. then you have a case and can pursue via the small claims court.

OHforDUCKScake · 26/08/2012 19:46

Gum tree....

Can I still do that?

OP posts:
CocktailsAndFriedChicken · 26/08/2012 19:48

There is no buyer protection with gumtree. How did you pay, and what was the wording in the advert?

OHforDUCKScake · 26/08/2012 19:52

I cant even remember the wording and we paid in cash.

Its only £50 but ffs thats a huge deal to us.

OP posts:
CocktailsAndFriedChicken · 26/08/2012 19:55

You need to find the advert again, the wording is vital.

OHforDUCKScake · 26/08/2012 19:57

Ok Im going to check my msgs and email now.

OP posts:
OHforDUCKScake · 26/08/2012 20:14

His advert gone. No messages buy his saying his address.

Fuck.

OP posts:
CocktailsAndFriedChicken · 26/08/2012 20:20

If you don't delete your browser history you might be able to find the advert you looked at.

CocktailsAndFriedChicken · 26/08/2012 20:22

Or you can try Gumtree help to get a copy

cozietoesie · 26/08/2012 20:26

OP

In case you get nowhere, have a google on the problem. I've done that and seen what look like solutions and step by step instructions for fixing (sounds like the defrost cycle has been interrupted) on the web. Might not cost you much, if anything, if you're handy.

OHforDUCKScake · 26/08/2012 20:27

Thank you

DesperatelySeekingPomBears · 26/08/2012 20:32

Could be a broken thermostat. Dead easy and cheap to fix As long as the compressor isn't making a 'brr-click'ing noise that's probably what it is.

SoleSource · 26/08/2012 20:32

Rip off merchant. He'll get his.

ShellyBoobs · 26/08/2012 20:45

What a tight bastard, Ducks.

I can't get over people who would purposely rip someone else off like that.

Angry

Hope it's an easy repair, as others suggest it might be.

OHforDUCKScake · 27/08/2012 08:59

He said he'd call the police if I kept calling him. Wtf is he going to say?

"I sold a fridge freezer to somone, its broken and now shes pissed off with me and keeps calling."

Ive contacted Gum Tree, but I doubt it'll help.

Its my 30th in a few weeks so when I called mum in fridgefreezer panic she bought be a fridge as a 30th present and gave me her freezer.

So I have this old heap of shit to sort of now.

Stick it out front - the totters will have it away for scrap in the blink of an eye

picnicbasketcase · 27/08/2012 09:01

What a tosspot. I don't think there'll be much you can do apart from asking Gumtree to ban him selling anything else, if they can even do that.

cozietoesie · 27/08/2012 09:02

Or put it on Freecycle mentioning the fault. Saves you spending good cash to have it taken away.

ShiftyFades · 27/08/2012 09:03

We had a Hotpoint which froze solid at the back / bottom.
Defrost with a hair dryer. Take off the rear panel (inside) and you may find the drainage hole is the problem - it was for us. It was a design fault with that particular one.
Good luck OP Sad

Bossybritches22 · 27/08/2012 09:08

Jumping is right. It's recycling!

We have a brilliant set of "scrap dealers" who come round regularly & just take whatever is left outside. Some even knock on the door to check it's Ok first!!

I once put an old dishwasher out late on Sunday afternoon & it was gone by 9am Mon.

Saves lugging it to the tip or paying the council to collect. If they can get a few bob for it as scrap they're welcome!

OP have a look at the BHF website They have all sorts of good quality second hand goods for sale & they check all electricals before re-selling, if you need anything else.

Good luck with getting hold of that cowboy.

OHforDUCKScake · 27/08/2012 09:46

I used to do that in my old place but where we live now its dead posh. We already stand out like sore thumbs, crusty parents with our crusty children. I think our neighbours would die if we left stuff outside plus our landlady is 'around' a lot and that would not go down well. DP's just taken it to the dump.

Problem over, I contacted GT but Im not sure it'll help.

Still, you live and learn.
